All ADF personnel as with AFP have under the agreement with the host government , indemnity from prosecution under Timor-Leste law. To say they will be investigated by UN and Timor-Leste auhtorities is nonsense. They cannot porsecute him anyway. The previous blogger is also right in that self defence needs to raised and proved. It is under Australian criminal law a defence to a charge of homicide, to be proved by the accused or a person under investigation. It is always safer for an incident causing death to be subject of at least a pre-trial hearing like a committal hearing or coroners inquest.
Given the heightened tension between ADF personnel and Easterners it is neccessary for the sake of transparency.
Questions might be relevant to self defence including whether or not orders are being followed from a superior which might assist the soldier from proving his innocence.
Given what I have heard some officers, with rank as high as Colonel say about easterners (such as "Alkatiri's dogs", "rebels", "Taur Matan Ruak's militia" etc) the state of mind at the time the soldier attended at the IDP camp is extremely relevant.
This could bring to the open questions such as those about political bias or other influencing non military operational factors. These factors are well and truly public knowledge here in East Timor and little known by your average Aussie.
There is alot which needs to be sorted thorugh before we can just say "self defence". What were the actions of the soldiers prior to the attack? Was the youth acting in self defence protecting hinself and his family in retaliating against the soldiers or others soldiers threat to his or his families life or person? These are all relevant questions.
But what Mr Downer meant to say was: "This boy is a white digger. The other fellow was a half baked savage. He probably desreved it. " As if to say, the right to bear arms and defend yourself, is exclusively that of the powerful and developed. Not the weak and under developed.

Todo o pessoal da ADF bem como o da AFP está aí sob acordo com o governo hospedeiro, imunes a prossecução sob a lei de Timor-Leste. Dizer que serão investigados pela ONU e autoridades de Timor-Leste não tem sentido. Eles não podem processá-lo de maneira nenhuma. O leitor anterior tem também razão (quando diz) que a auto-defesa precisa de ser levantada e provada. Segundo a lei criminal Australiana uma defesa para uma acusação de homicídio, (deve) ser provada pelo acusado ou pela pessoa sob investigação. É sempre mais seguro num incidente que cause a morte ser sujeito pelo menos a uma audição pré-julgamento como uma audição por mandato de prisão ou a um inquérito judicial por investigadores.
Dadas as tensões aumentadas entre o pessoal da ADF e os do Leste (isso) é necessário a bem da transparência.
Interrogatórios podem ser relevantes para a auto-defesa incluindo se sim ou não estavam a seguir ordens de um superior que pode assistir o soldado a provar a sua inocência.
Dado o que tenho ouvido alguns oficiais, com graduações tão altas como Coronel dizerem acerca dos do Leste (tais como "cães de Alkatir ", "rebeldes", "milicianos de Taur Matan Ruak " etc) é extremamente relevante declarar o estado de espírito na altura em que o soldado entrou no campo de deslocados.
Isto pode trazer para a luz do dia questões de preconceitos políticos ou outras que influenciam factores operacionais não militares. Esses factores são na verdade bem conhecidos pela população aqui em Timor-Leste e pouco conhecidos pelo Australiano médio.
Há muitas coisas que precisam de ser esclarecidas antes de podermos afirmar “auto-defesa”. Quais foram as acções dos soldados antes do ataque? Estava o jovem a actuar em auto-defesa a proteger-se ele próprio e a sua família em retaliação contra a ameaça do soldado ou de outros soldados contra a sua vida ou contra a vida da sua família ou pessoa? Todas estas questões são relevantes.
Mas o que o Sr Downer queria dizer era: "Este rapaz é um soldado branco. A outra criatura era um selvagem meio feito. Provavelmente mereceu isso. " Como quem diz, o direito de usar armas e de auto-defesa é exclusivamente dos poderosos e desenvolvidos. Não dos fracos e subdesenvolvidos.

Who asked the australian troops to respond to a disturbance? What kind of disturbance? Isn't that a Police business instead?
"To fire on someone in self-defence is within the rules of engagement," Mr Downer said.
YES, to fire on someone.
NOT to kill someone.
There's a big difference in between and a soldier should know it.
"The incident is being investigated"? Yes, just like previous incidents: the australian flag raised on a public building; some police officers swearing at female drivers or paying some kids to damage somebody else's cars; troops forcing two police senior officers to undress on the street; armoured cars in the sea, damaging the coral reef; Gen. Taur Matan Ruak being detained by ADF troops...
It looks like the australian troops have decided to create an incident to justify the warnings issued by australian authorities in the last couple of days.
The ADF can only shoot against innocent people, not against gangsters like Reinado!
Mr. Howard, your hands are tainted with blood!
