Hércules: MAIS UM CASO PARA AS GAVETAS DE LONGUINHOS MONTEIRO

Hércules Rosário Marçal, o gangster timorense radicado na Indonésia, foi detido pela polícia indonésia, juntamente com outros sete criminosos, na capital, Jacarta. A notícia foi veiculada pela comunicação social e também pelo The Jakarta Post, peça jornalística que poderá ver no TLN versão em inglês.

Até aqui tudo normal. Criminalidade existe em todo o lugar, em todos os países, em todo o mundo. O que não será normal é recordarmos que o actual governo timorense tem mantido relações especiais e agradecidas com este gangster, já há muito referenciado e agora detido pela polícia indonésia.

Em 6 de Agosto passado podíamos ler no jornal Timor Post, de Díli que o governo agradecia a Hércules pela contribuição prestada ao progresso do país, completando: “O Governo timorense expressou o seu agradecimento e apreciação ao gangster indonésio Rosário Marçal conhecido como "Hércules" que contribuiu com dinheiro para arranjar os jardins da capital, ocupados pelos deslocados internos (Timor Post, 06.08.08)”.

Entretanto, também é de conhecimento geral, por ter sido noticiado, que Hércules iria investir em Timor-Leste em negócios e que por isso, alegadamente, teve reuniões com elementos do governo. Acresce que já anteriormente, antes de 11 de Fevereiro, Hércules esteve reunido com governantes ou até mesmo com Xanana Gusmão, como consta.

Sobre tais factos podemos considerar tudo anormal. Governantes e um governo que tão bem se relacionam com um gangster? Que fazem negócios com um gangster? Que tecem agradecimentos e elogios a um gangster? Que se reúnem com um gangster em gabinetes de edifícios oficiais?

Então, mas o governo AMP quer fazer de Timor-Leste uma plataforma de crime e lavagem de dinheiros conseguidos ilicitamente? Temos aqui mais um governo como o da Guiné-Bissau, onde imperam os barões e os lacaios da droga?

Como se pode constatar facilmente o governo da AMP não pode dizer que desconhecia quem era o senhor Hércules no mundo do crime e que por isso lhe deu trato de honrado investidor. Assim, partindo do princípio de estarem a par de tudo como puderam aceitar os “serviços” de um criminoso da pior estirpe? Que “negócios” é que o governo AMP ou elementos do governo da AMP tiveram e têm com este gangster paralelamente aos que são conhecidos publicamente?

Certo é que a partir daqui podemos entrar em eventuais especulações perfeitamente legítimas e a culpa será dos que estão a confirmar as afirmações de Mário Carrascalão antes da formação da AMP, em que deixava entender que o CNRT era um aglomerado de bandidos. Não será?

Xanana Gusmão, tão autoritário que demonstra ser para umas coisas, porque razão nunca reagiu a este estado de coisas, a este descalabro de promiscuidades governamentais com um gangster conhecidíssimo?

As perguntas ficam - enquanto não surgirem respostas devidamente fundamentadas, o que, parece, como de costume, não irá acontecer. Mais um caso para as gavetas de Longuinhos Monteiro, as tais que até já estão cheias de teias de aranha, onde até mora o “caso 11 de Fevereiro”, entre outros.

NÃO PODEMOS SER MUDOS À LIDERANÇA CEGA E SURDA

Como foi possível que personagens de uma luta de libertação do país e dos timorenses se enquadrassem na sua entrega a interesses estranhos e na sua fidelidade à traição?

Se ainda há quem queira mais provas sobre o estatuto assumido por Xanana Gusmão de que está a ser ditador e desonesto basta recordar a sua postura quando a oposição se referiu à inconstitucionalidade da proposta no Parlamento Nacional, que a AMP apresentou para criar as condições que lhes tem permitido manusear dinheiros de forma ilícita. Nessa altura Xanana nada ouviu. Fez-se surdo. Se um se fez surdo o outro assinou de cruz, fez-se cego, Ramos Horta.

A falsidade demonstrada por Horta veio revelar quanto nos tem enganado. Se para muitos esta foi a acção que constituiu prova que baste ainda haverá uns quantos que não consideram suficiente, para outros tudo ficou muito mais claro. Dissiparam-se dúvidas.

Não há como pretender ilibar o Presidente deste imbróglio. Não há como querermos admitir que Horta fez o que fez por acaso e que por engano a lei seguiu para publicação. Foi uma jogada suja. Tão suja quanto as anteriores e que a maioria de nós não quis ver.

A falta de integridade, de honestidade, de características de pessoas de bem da liderança destes personagens é cada vez mais evidente. Não que não tenha havido quem para isso alertasse. Não que ao longo de todos estes anos não tivessem eles revelado estarem em sintonia numa deslealdade escaldante e ao serviço de todos menos de interesses Timorenses. O país está a ser entregue ao desbarato por mãos timorenses que estão a trair os propósitos que assistiram a luta de libertação. Isso é evidente. Resta-nos não sermos mudos, não calarmos a nossa indignação pelo comportamento desta elite cega e surda.

Acórdão sobre OGE motiva batalha de prazos, assinaturas e interpretações

Díli, 17 Nov (Lusa) - Prazos ultrapassados, notificações extraviadas e interpretações opostas estão no centro da batalha política desencadeada em Timor-Leste por um acórdão do Tribunal de Recurso (TR).

O TR deu razão a parte dos argumentos contra a lei de alteração do Orçamento Geral do Estado (OGE) 2008, de 05 de Agosto.

A fiscalização sucessiva da constitucionalidade e legalidade do chamado Orçamento Rectificativo foi pedida ao TR por dezasseis deputados da oposição no Parlamento, numa acção liderada pela Fretilin.

O acórdão do TR ainda não foi publicado em jornal oficial e, como tal, ainda não produziu efeitos legais e, pela mesma razão, ainda não é do conhecimento oficial do Governo, afirmaram à Lusa diferentes assessores jurídicos em Díli.

Desde sexta-feira, no entanto, que a Fretlin do ex-primeiro-ministro Mari Alkatiri e o Governo de Xanana Gusmão trocam declarações públicas com base num texto que apenas conhecem por canais oficiosos.

“O acórdão do TR só passa a ter vida após a publicação no Jornal da República. Isso deve acontecer ainda esta semana, mas imaginemos, por exemplo, que havia uma avaria na tipografia. Tudo continuaria sem efeito”, comentou um dos juristas ouvidos pela Lusa.

Entre as fontes ouvidas pela Lusa, a ironia e a incredulidade misturam-se à gravidade das consequências legais e políticas do acórdão e da sua questão central — a legitimidade da orçamentação de centenas de milhões de dólares norte-americanos no OGE rectificativo, que mais do que duplicou o OGE original para este ano.

Na reclamação que deu entrada hoje no TR, e a que a Lusa teve acesso, Fernando “La Sama” de Araújo, o presidente do Parlamento, refere em “questão prévia” que esta instituição “nunca teve conhecimento da existência deste processo, para além da notificação do dia 13” de Novembro.

Mais adiante, “La Sama” de Araújo sublinha a sua “absoluta surpresa” com a notificação de quinta-feira passada.

O motivo desta “questão prévia” é o Parlamento ter perdido o prazo legal de vinte dias para responder ao tribunal, contados a partir da citação “na pessoa do presidente”, antes da redacção final do acórdão.

Fonte judicial confirmou à Lusa que “existe no TR o papel com a assinatura do secretariado do Parlamento atestando o recebimento da citação em devido tempo, no início de Outubro”.

Uma fonte parlamentar admitiu hoje à Lusa que a citação para o Parlamento responder ao TR, antes do acórdão, “foi deixada em cima de um armário” por um elemento do secretariado, “a mesma pessoa que assinou a notificação quinta-feira passada”.

Fernando “La Sama” de Araújo, em todo o caso, alega na reclamação entregue hoje no TR que “não cabem, não podem caber, dúvidas de que o direito de reclamação (ainda) existe”.

A reclamação de Fernando “La Sama” de Araújo alega que o acórdão devia resultar de uma decisão do plenário de juízes do TR, ao todo seis magistrados.

O acórdão é assinado apenas por três juízes: o presidente do TR, o timorense Cláudio Xímenes, o português Ivo Rosa, juiz relator, e um segundo juiz internacional, o guineense José Luís da Góia.

A reclamação questiona a competência da assinatura do juiz presidente, uma vez que “é do conhecimento público e consta do processo” que Cláudio Xímenes “se encontra em ‘tratamento de saúde’, há longo tempo fora do país”.

“Pode e deve concluir-se que o juiz Cláudio Xímenes não se encontra em efectividade de funções”, diz a reclamação.

Fonte judicial em Díli afirmou à Lusa que o juiz presidente do TR recebeu as peças do processo “por correio expresso” em Lisboa, onde se encontra hospitalizado.

Ivo Rosa, como juiz relator e presidente interino do TR, é criticado de forma particular pela reclamação de “La Sama” de Araújo.

“Esteve mal o Alto Tribunal ao qualificar erradamente a Lei do Fundo Petrolífero como ‘lei de valor reforçado’”, diz a reclamação ao defender o aumento da dotação das receitas do Mar de Timor transferida para o OGE.

“La Sama” de Araújo acusa também o TR de usar um normativo estrangeiro ao decidir sobre a inconstitucionalidade de uma norma relativa à discriminação da despesa.

“Com o devido respeito, o Alto Tribunal parece inclinar-se para interpretar uma norma programática da Constituição à luz de preceitos de outro ordenamento jurídico, ‘verbi gratia’, a Lei de Enquadramento Orçamental Portuguesa”, acusa o presidente do Parlamento timorense.

“La Sama” alega ainda que o acórdão padece de uma “manifesta contradição entre a decisão e os fundamentos que a determinam”.

A Lusa tentou, sem sucesso, contactar o juiz Ivo Rosa para comentar a reclamação do presidente do Parlamento.

Decisão do Tribunal de Recurso sobre orçamento "labora em grave erro", acusa presidente do Parlamento

Díli, 17 Nov (Lusa) - O presidente do Parlamento Nacional de Timor-Leste acusou o Tribunal de Recurso (TR) de “laborar em grave erro” no acórdão sobre o Orçamento de Estado rectificativo para 2008, segundo um documento a que a Agência Lusa teve hoje acesso.

“Mais uma vez, o Alto Tribunal labora em grave erro, aplicando instrumentos jurídico-normativos que não existem no nosso ordenamento jurídico-constitucional, e ignorando aqueles que estão em vigor”, acusa Fernando “La Sama” de Araújo.

O TR, em decisão de 27 de Outubro de 2008, considerou inconstitucional a lei de alteração orçamental de 05 de Agosto “na parte que aloca ao Fundo de Estabilização Económica a quantia de 240 milhões de dólares norte-americanos”.

No mesmo acórdão, a que a Lusa teve hoje acesso, o TR declarou a ilegalidade da norma que “determina o montante das transferências do Fundo Petrolífero para 2008 em valor superior a 396,100,000 (trezentos e noventa e seis milhões e cem mil dólares norte-americanos)”.

O acórdão do TR deu entrada no Parlamento quinta-feira ao final do dia mas ainda não foi publicado no jornal oficial da República.

O presidente do Parlamento respondeu ao acórdão com uma reclamação que deu hoje entrada no TR e em que pede “ser declarada a nulidade de todo o processuado”.

Fernando “La Sama” de Araújo pede também que seja declarada “a nulidade do acórdão por manifesta contradição entre a decisão e os fundamentos que a determinam”.

O acórdão do Tribunal de Recurso deu razão a dois dos quatro principais pontos que justificaram um pedido de fiscalização de constitucionalidade da lei de rectificação orçamental, apresentado no final de Julho por dezasseis deputados da oposição.

O secretário-geral da Fretilin, Mari Alkatiri, anunciou a decisão “favorável” do Tribunal de Recurso numa conferência de imprensa em Díli, sexta-feira, salientando que o acórdão não afecta os gastos efectuados até agora pelo Governo.

“É preciso ter cuidado para que o Governo não comece a inventar recibos com datas anteriores para contornar a decisão do Tribunal”, disse Mari Alkatiri em declarações à Lusa.

“Toda a atenção está agora centrada nesse detalhe”, acrescentou o líder da oposição.

“Se o fizerem é crime e terão de responder criminalmente. Se não for agora será quando houver mudança de Governo”, avisou Mari Alkatiri.

O líder da Fretilin acrescentou ainda que a decisão do Tribunal coloca o Governo em crise porque “se tinha planos para gastar o dinheiro não o vai poder fazer e isso precipita uma decisão de realizar novas eleições”.

No mesmo dia, o porta-voz do Governo e secretário de Estado do Conselho de Ministros, Hermenegildo “Agio” Pereira, afirmou em comunicado que, "enquanto a decisão não for publicada no Jornal da República, o Governo não tem conhecimento oficial do acórdão proferido pelo Tribunal de Recurso".

“Agio” Pereira sublinhou que a "normal actividade governativa está plenamente assegurada".

O Executivo, disse ainda o secretário de Estado, "tem agido sempre com base na lei e o TR decidiu que todos os actos praticados pelo Governo até à data têm sido legais".

Excellency Mr. President of National Parliament
To all Distinguished Parliamentarians,
To all the Maubere people,

Today the FRETILIN bench wants to present in Parliament (cultural house of the Maubere people) the fundamental question of food security in connection with food to sustain people's lives and budget that has been spent and that is to be spent in 2008.

The Food Security Fund was created as a mechanism that the FRETILIN government created with the intention to not only buy rice but to provide support to farmers to increase their capacities and to ordinary people to gain protection through having sufficient food.

After more than a year, the de facto AMP government has spent millions of dollars on the budget item Food Security Fund with money that has been moved from the Economic Stabilisation Fund with the intention to assist people who have difficulty obtaining food – but perhaps the intention was to fatten up as well some of their colleagues and friends, which included the quick expenditure of the budget that was approved by Parliament in July 2008, in particular the Economic Stablisation Fund.

The food shortage problem, especially rice, has become a big problem in our nation since the de facto AMP government began governing this country – because the question of food shortage has occurred in many districts in Timor-Leste which has made the de facto AMP government buy and sell rice to their own Maubere people.

Mr. President and all parliamentarians,

The question of buying and selling rice to the people has become the principal reason from the de facto AMP government to ask the representatives of the people who sit in parliament to approve a very big budget in the 2008 Ratified Budget.

From the very beginning of the year, the de facto AMP government sold rice to the Maubere people with the very high official price of $17 each sack but the price rose to as high as $40 a sack when sold in the market in some districts. Despite the government using the reason of intervention to normalize the price of rice in the market – this normailsation has instead become an instrument of the government to raise the price of rice which was sold at a price of $12 to $15 in the tome of the FRETILIN government. The FRETILIN bench is concerned with this policy of intervention from the government through the Food Security Fund and the Economic Stabilisation Fund.

Just after the de facto AMP government came into place – the FRETILIN bench registered that the previous FRETILIN government had total of 17,582.57 tonnes of rice in storage. The previous government bought this rice at a price of not more than $500USD. The FRETILIN bench is very concerned why rice is being sold at a price of $17 a sack when it was bought for $500USD?

In the General Budget for the Transitional Period 2007 – the government requested total amount of $6,880,000USD for the Food Security Fund and this item was not spent, as reported in the 31 March 2008 final report of Execution of the Transitional Budget 2007, which was carried over to the total amount of $5,799,986USD.

But the food security item was increased in the 2008 General Budget to the amount of $5,352,000USD before the budget was ratified. The budget from the Food Security Fund is always increasing and then the parliament approved again the budget item of $11,867,000 but in reality the de facto AMP government has spent, since the budget of the transitional period, a total of $24,546,986USD.

The FRETILIN bench wants to know the total amount of money spent on food security, how many tonnes were bought and how many tonnes were sold? What was the contract process of the de facto AMP government and how did they carry it out? Was the Tender Regime applied or not? And why is the price of government rice so high?

We are concerned that perhaps the government contracts for buying rice were awarded by raising hands as occurred in the contract to Três Amigos, the company of which the director was formerly the director of finance and administration in the Office of the President when the current de facto Prime Minister was President of the Republic.

Parliamentarians,
The FRETILIN bench sees that the policy of buying rice from the AMP government has become an instrument to spend the people's money quickly and without any control. In the month of October just after the approval of the 2008 ratified budget the FRETILIN bench registered that the government has already made contracts to buy rice with 7 companies, with money taken out of the Economic Stabilisation Fund. The companies that have been awarded contracts to buy rice are as follows:

1. Sebajaya; 1,615,000
2. Atramor; 1,848,640
3. Belun Feto; 3,842,500
4. Três Amigos; 3,843,500
5. Star King; 3,842,000
6. Maubara Fitun Naroman; 3,843,000
7. United Food; 3,842,500

The total amount of money spent from the Economic Stabilisation Fund to the companies listed totals 22,676,140 USD.

The FRETILIN bench has also noted that through the contracts that the de facto AMP government has awarded to the above named companies the government has also allocated money from the Economic Stabilisation Fund to a total of $57,371,750UDSD to buy rice, which brings the total amount of $80,047,890USD was spent to buy rice utlilising money from the Fund.

Parliamentarians,

The de facto AMP government, which has only recently come into power, has spent total of $104,594,876USD to buy rice. The amount of money that the government is spending to buy rice from the utilizing money from the Food Security Fund and Economic Stabilisation Fund deeply concerns the FRETILIN bench.

The fundamental questions that the representatives of the Uma Fukun (Parliament) have are as follows:

1. Was the people's money that was spent was to buy rice provided to those who really needed it?

2. The policy of the Food Security Fund and the Economic Stabilisation Fund is for the benefit of the company Três Amigos and the Prime Minister or for the poor? The FRETILIN bench notes that the director of Três Amigos Mr. Germano da Silva, previously the director of Administration and Finance in the Office of the President, received a contract worth $17,842,500USD

3. The expenditures were made applying the Juridical Regime for Tender or not?

4. Finally, FRETILIN bench would like to ask for copies of all the contracts that the de facto AMP government has made with companies to buy rice and how much of the rice has been sold to Maubere people and how much is to be sold?

Distinguished parliamentarians, all Maubere people,

In conclusion, the FRETILIN bench's political declaration sees that the policy of the AMP government is to fatten their business friends rather than their people who have to buy rice at a high price. The FRETILIN bench sitting in today's plenary will hold a parliamentary enquiry to the de facto AMP government according to the RDTL Constitution, articles 95, no. 3 and 101, no. 2 and articles 14h, 139 and 140 of the National Parliament Regiment, to discuss the extremely relevant question of national interests and material discussion of the subject of Food Security Fund and Economic Stabilisation Fund to buy rice for the Maubere people.

Timor Leste's de facto government appears determined to try to thwart the Court of Appeal's decision against its failed 2009 budget, FRETILIN's parliamentary leader Aniceto Guterres warned today.

The collective made up of three Court of Appeal judges on November 13 unanimously ruled against the budget's two key pillars – the US$240 million so-called "Economic Stabilization Fund" (an unconstitutional slush fund) and the illegal transfer of US$290.7 million from the Petroleum Fund to the budget.

Speaking in Dili, Aniceto Guterres said: "The court's decision was, and I paraphrase its own words, to:

a) Declare the unconstitutionality, with the force of general compliance, the following provision:

The provision in line o), of no. 3 of article 1 of law No. 12/2008 of 5 August, whereby the amount of 240 million US dollars is allocated to the Economic Stabilization Fund.

b) Declare the illegality, with the force of general compliance, the following provision:

The provision 3 of article 1 of Law No. 12/2008 of 5 August, whereby it stipulates the amount of transfers from the Petroleum Fund for 2008, in an amount in excess of $396,100,000 (three hundred and ninety six million one hundred thousand) US dollars.

"This is clear for all to read. However in a media release dated 14 November 2008, the spokesperson for the AMP de facto government contradicted the court decision, declaring that 'the Economic Stabilisation Fund is in accordance with the Constitution of the Republic of Timor-Leste and is compliant with the law'.

"This is simply untrue and indicates their intent to thwart the court's ruling which severely embarrasses the de facto government," Guterres said.

"The AMP spokesperson's media release also said: 'While the decision is not published in the Official Gazette, the Government does not have official knowledge of the decision made by the Court of Appeal', adding that the court decision 'limits the "unconstitutionality" and the "illegality" to the period after the publication of the judgement in the Official Gazette. Which means that, whatever the amount that has already been withdrawn from the Petroleum Fund thus far, it would never be unconstitutional nor illegal.'

"This interpretation is self-serving and false," Guterres said.

"On page 51 of its decision the court said:

'In the face of the previously stated, it is decided to limit the effects of this declaration of unconstitutionality and illegality, as a means of safeguarding the acts of a financial and budgetary nature, undertaken up to the date of the communication of this decision to the National Parliament.'


"The court has declared these budget measures illegal and unconstitutional while limiting the effect of its declaration, because of the impact it would have on the state. These acts have not been forgiven or sanctioned, the government has merely been given a reprieve from having to reinstate or pay restitution to the state.

"This is an act of good faith by the court to maintain stability in the financial system and society. It does not diminish the fact that they were illegal and unconstitutional acts for which this government and the majority in the parliament have to account for.

"The statement by the spokesperson for the government shows they intend to find any way to circumvent and thwart the court's ruling against them. FRETILIN will take further legal action to seek legal remedies for any contravention of the court's decision.

"We warn the de facto government against rushing to pay out amounts of money on the ludicrous basis that they are not formally notified of the court's decision until the Official Gazette publishes the decision. Given that the government controls the Official Gazette (Jornal da Republica) and the timing of its publication, this would be the ultimate in cynicism and bad faith.

'We call on the government, especially the Prime Minister and his Minister of Finance to come to the Parliament and explain to the people's representatives what the exact budget situation is. We need to know exactly how much cash has been paid to the 13th of November 2008, what amount is pending as partial remaining payments and what agreements the government is not at this stage obligated to pay, and therefore according to the court decision should not be paid from the amount in excess of US$396.1 million drawn from the Petroleum Fund in breach of the constitution.


"It is important that the administration does this, so that we are all certain that no more illegal or unconstitutional acts are perpetrated."

"We call on the government to exercise good faith and stop the slide into an institutional and potentially constitutional crisis," Guterres concluded.

Tribunal de Recurso declara Fundo de Estabilização Económica inconstitucional

Macau, China, 14 Nov (Lusa) - O Tribunal de Recurso de Timor-Leste declarou inconstitucional o Fundo de Estabilização Económica, uma rubrica do Orçamento de Estado aprovada pelo Parlamento sem plano de despesa, disse hoje à agência Lusa Mari Alkatiri.

Contactado telefonicamente a partir de Macau, o líder da Fretilin explicou que o Tribunal de Recurso, que tem poderes de fiscalização constitucional, declarou a “inconstitucionalidade” do Fundo além de classificar também de “ilegal” a transferência do Fundo do Petróleo acima do permitido.

“Este fundo, uma espécie de ‘saco azul’ de 240 milhões de dólares para o Governo utilizar como bem entendesse, foi criado com transferências acima do permitido pela Lei que regula o Fundo de Petróleo”, disse Mari Alkatiri.

As transferências do Fundo de Petróleo de Timor-Leste estão reguladas em norma própria, existindo uma fórmula de cálculo a ser aplicada para garantir a sustentabilidade futura da reserva financeira.

Mari Alkatiri explicou também que o Tribunal “foi generoso” aceitando todas as despesas já efectuadas pelo Executivo de Xanana Gusmão, uma decisão que deixa preocupada a oposição.

“É preciso ter cuidado para que o Governo não comece a inventar recibos com datas anteriores para contornar a decisão do Tribunal”, disse Alkatiri ao sustentar também que “toda a atenção está agora centrada nesse detalhe”.

“Se o fizerem é crime e terão de responder criminalmente. Se não for agora será quando houver mudança de Governo”, avisa.

Mari Alkatiri acrescentou ainda que a decisão do Tribunal coloca o Governo em crise porque “se tinha planos para gastar o dinheiro não o vai poder fazer e isso precipita uma decisão de realizar novas eleições”.

O Orçamento rectificativo já tinha sido criticado por organizações internacionais e deixado em alerta o Fundo Monetário Internacional devido ao aumento da despesa em 122 por cento face ao documento original, gastos potenciados pela criação e aumento de subsídios e vencimentos, construção de uma central de fuel óleo e rede de distribuição eléctrica.

A própria promulgação do Orçamento por parte do Gabinete de Ramos Horta esteve envolta em polémica já que o chefe de Estado tinha levantado dúvidas sobre o Fundo de Estabilização Económica.

Ramos Horta queria esperar pela decisão do Tribunal de Recurso mas antes de deixar Díli para uma visita a Pequim assinou o Orçamento rectificativo para o caso do Tribunal o declarar constitucional.

O documento acabaria, no entanto por ser enviado para publicação no primeiro dia de ausência de Horta do país, validando a proposta aprovada no parlamento.

Em Dezembro de 2007, o Parlamento timorense aprovou o Orçamento de 2008 no valor de 347,5 milhões de dólares norte-americanos e a nova proposta apresentada no final de Junho aumentava as provisões orçamentais para o mesmo ano num total de 773,3 milhões de dólares.

A rectificação no Orçamento significava um aumento de 425,6 milhões de dólares nos gastos públicos para este ano em relação ao Orçamento aprovado no final de 2007.

Dos 773,3 milhões de dólares, 686,8 milhões de dólares eram financiados por transferências do Fundo Petrolífero.

Landmark court ruling creates budget crisis for Gusmão government

Yesterday's Court of Appeal decision outlawing the Gusmão-led government's transfer of US$390 million from the national petroleum fund to government coffers has created an institutional crisis in Timor-Leste because the government no longer has any money to spend from the budget, FRETILIN said today.

The unanimous Court of Appeal decision of three judges ruled that the government's creation of the Economic Stabilization Fund and the withdrawal of US$390 million from the Petroleum Fund breached the Constitution and the Petroleum Fund Law.

FRETILIN's leader in the National Parliament, Aniceto Guterres, said today: "FRETILIN, its political allies and Timorese civil society warned the Gusmão-led AMP government many times before and during the debate on the supplementary budget that the proposed withdrawal from the petroleum fund was unconstitutional but they ignored our advice.

"The people of Timor-Leste now await a prompt, appropriate and law-abiding response from this government and its parliamentary allies to a constitutional, institutional and financial crisis of their own making.

"The Court of Appeal decision today means that the government budget for the whole for 2008 is US$360 million, or US$390 million less than the US$773.4 million it assumed was previously available.

"The budget execution report issued by the government for the three quarters ending September showed the government claimed at that stage it had already spent more than US$455 million this year, including US$60 million from the US$390 million which the Court declared unconstitutional.

"The government now only has money to provide some community services and pay some civil servants until the budget for 2009 is approved.

"The Court decision also prohibits the government from accessing Petroleum Fund money to pay for spending on budgeted government contracts awarded without a lawful and transparent tender process.

"This includes the environmentally devastating heavy oil power station which was rejected by a majority of members of parliament, and the naval patrol boats it has ordered.

"The government also cannot spend any more money from the Economic Stabilization Fund as the fund was declared to be unconstitutional."

Aniceto Guterres said that even before FRETILIN received notification of the Court's decision, certain members of the government were trying to use illegal means to continue spending money in violation of the Court's decision.

Guterres said: "Government ministers, public servants and international advisers could face prosecution for devising schemes, including the backdating of receipts and contracts, to breach the Court's decision."

Chega Debate, Points to the Cemetery Where the Santa Cruz Massacre Occurred,
Judge the Perpetrators of the Crimes Now ….!!!


Today we are all thinking back on the major event which took place 17 years ago, thinking anew about an event with significant impact for our youth and which woke up the international community. We know that our independence was not a gift from the invading nation not from the international community, rather our independence came from all our people’s sacrifices, and the sacrifices of those who gave their lives for the liberty of our country. Since the liberation of our country, in the past eight years the victims of the Santa Cruz massacre have yet to achieve truth or justice, those responsible from the invading Indonesian military who committed grave crimes have yet to be brought before a court and judged. Worse yet, our leaders in Timor-Leste have launched cheap propaganda claiming we must forget our past suffering because Timor-Leste no longer needs justice.

Deputies in the National Parliament currently prioritize discussion on the purchase of luxury cars for their use rather than give importance to the Chega Report. As families of the victims, we will never forget and remain sad today due to the loss of so many loved ones taken from us. Even sadder because until today we do not know where our loved ones were buried; where are the remains of those who gave their lives on that day? Why have they not only lost their lives, but also their bodies have disappeared? Because of this, the victims’ families will not be silent but continue to call for those who took the lives of our loved ones to take responsibility for their action. We are independent but still searching for the truth and justice to satisfy those of us who lost so many of our loved ones. Consequently, ANTI makes the following demands:

We demand the Indonesian Government reveal where those killed in the Santa Cruz Massacre of November 12, 1991 are buried as truth telling to the victims’ families.

We demand the Timor-Leste National Parliament give priority to discussing the CAVR or Chega Report in November 2008!

We demand the governments of Timor-Leste and Indonesia judge, in a court of law that is impartial and just, the perpetrators of the crimes of the Santa Cruz Massacre as a means to end the chain of impunity in Timor-Leste and Indonesia .

We demand the United Nations take the perpetrators of the Santa Cruz Massacre before an international tribunal as a step towards fulfilling the process of democratization, reconciliation and friendship between Indonesia and Timor-Leste.

We demand that the government of Timor-Leste give priority to justice, to prevent the growing impunity in our country.

If there is no justice, reconciliation is not viable;
If there is not truth, democracy is not viable;
Peace and development will remain illusive throughout our country if justice does not exist!

President of parliament stops debate on recommendations of truth commissions

The President of Timor Leste's parliament, Fernando Araujo Lasama today postponed for the second time any debate in parliament about the recommendations of the two main reports on human rights abuses under the Indonesian occupation between 1975 and 1999. MPs from FRETILIN, the larges party in the parliament, strongly objected.

FRETILIN's parliamentary leader, Aniceto Guterres, who was also the Chair of the Truth, Reception and Reconciliation Commission (CAVR), and a Member of the Truth and Friendship Commission (TFC), today condemned the postponement for the second time by the President of the National Parliament of the debate on the recommendations of the reports of the two historic Truth Commissions.

Two resolutions proposed by the multi party Parliamentary Committee for Constitutional Issues, Public Administration, Local Power and Government Legislation (Committee A) were set down to be debated on Monday this week, but were postponed to November 10. Yesterday debate on these draft resolutions was postponed yet again, indefinitely, by the President of the parliament in meeting with the leaders of the political benches.

"FRETILIN, PUN and the CNRT leader, want to proceed with the debate and pushed for it.

These parties are clearly the largest chunk of the seats in parliament. However, there was no support from the President or the other smaller parties. Instead they wanted an agreement to be reached first by all the parties on the two draft resolutions before President Lasama would schedule the debate in the parliament," said Guterres.

"But the proposal on which they wanted agreement was devoid of any acknowledgement or acceptance of the recommendations of either Commission recommending the pursuit of justice for the victims of the violence which occurred in our country between 1975 and 1999. This is something we could never agree to as representatives of a people whose aspirations were clearly expressed during the CAVR and TFC proceedings as being totally to continue to pursue justice.

We will never agree to the insistence that the resolution make no reference to the pursuit of justice for victims," said Guterres.

A media release from Committee A last week said:

The Parliamentary Committee for Constitutional Issues, Justice, Public Administration, Local Power and Government Legislation (Committee A) will present two resolutions to the National Parliament that recognize the achievements of both Commissions, acknowledge their findings, and propose implementation of their recommendations.

The proposed resolutions highlight CAVR and CTF recommendations in the areas of: victim reparations, a commission for disappeared persons, justice, education and the establishment of an independent institution to oversee implementation efforts.

"FRETILIN supports the Committee's stated desire to have the debate on the two draft recommendations. We condemn the manner in which the President of the National Parliament and a small group of MPs are trying to stifle open and democratic debate in our peoples' house, by making backroom deals. We reject this as totally non transparent and undemocratic. A multi-party committee has drafted two proposed resolutions which were approved unanimously and signed by all but one member of the multi-party parliamentary Committee. These are the processes for having resolutions brought before the parliament," added Guterres.

"All else aside, during the discussion between the leaders of the parties in the parliament and the President, it was clearly evident that there are still many of our colleagues who have not read and do not understand the substance of the recommendations made by the Commissions and their importance. We ask them to inform themselves of these basic facts before taking positions on the issue," Guterres urged.

Guterres has said that FRETILIN intends to move in the parliament next Monday for a motion that a debate on the draft recommendations by the Committee proceed, and that the parliament vote on the motion regardless of the President's expressed wishes.

"That's not how the parliament works. We the MPs should decide by majority the deliberations and proceedings. They are not and should never be dictated to us by the President. That has been the style of this President, but we are confident that will end next Monday. It is unfortunate to have to say that, but this is the reality in a poor parliament," Guterres said in closing.

O Comité Central da FRETILIN (CCF), reuniu-se, em Dili, no dia 08 de Novembro de 2008, em sessão alargada com a participação dos deputados, ex-deputados, ex-membros do Governo e representantes dos órgãos sub-nacionais do partido.

Durante a reunião, foram abordados vários assuntos de interesse partidário e nacional, entre os quais:

Relatório da Bancada Parlamentar da FRETILIN;
Relatório sobre o Processo de Reajustamento;
A Marcha de Paz;
As Eleições dos Líderes Comunitários;
O Mau Funcionamento do Parlamento Nacional;
Alteração da Lei dos Combatentes da Luta de Libertacão Nacional;
As comemorações do dia 28 de Novembro;
Os Projectos do Governo da FRETILIN.

Depois de um debate profundo sobre os assuntos agendados, o Comité Central da FRETILIN (CCF) deliberou:

Relatório da Bancada Parlamentar da FRETILIN:
Adoptar o Relatório como documento do Comité Central da FRETILIN;
Decidir editar uma brochura com todas as intervenções e interpelações dos deputados da FRETILIN no Parlamento Nacional, como forma de divulgação das actividades dos parlamentares junto dos militantes e do povo;
Relatório sobre o Processo de Rejustamento:
Adoptar o Relatório como documento do Comité Central da FRETILIN;

Dado o atraso dos trabalhos, como consequência do estado de sítio e de emergência, nos meses de Fevereiro a Abril de 2008, o Comité Central da FRETILIN exortou todos os militantes a engajarem cada vez mais no processo de modo a poder cumprir com o calendário estabelecido, condição necessária para se iniciar a Marcha de Paz.

A Marcha de Paz:
Adoptar a Declaração como documento do Comité Central da FRETILIN;
Reforçar as recomendações do Retiro de Holarua e as decisões da reunião do Comité Central da FRETILIN, de 09 de Fevereiro de 2008;
Delegar a Comissão Política Nacional as competências para a criação de uma Comissão Nacional Inclusiva Preparatória e Organizadora da Marcha de Paz;
Para além da inconstitucionalidade do Governo, mais razões se juntam - a má governação, o nepotismo e a corrupção generalizada, que só reforçam a necessidadde da realização da Marcha de Paz.

As eleições dos Líderes Comunitários:
Adoptar a exortação como documento do Comité Central da FRETILIN;
Exortar todos os militantes e apoinates da FRETILIN e o povo em geral, no sentido de exigir com veemência o Governo de facto da auto-proclamada Aliança da Maioria Parlamentar para a realização das eleições, em 2009;
Apelar a todos os militantes e simpatizantes para se empenharem activamente no reajustamento estrutural, para que através da participação activa nas estruturas partidárias locais, garantir a vitória da FRETILIN nas próximas eleições comunitárias.
O sistema político democrático de Timor-Leste é multipartidário. A nossa democarcia tem como base a organização dos cidadãos em Partidos Políticos, através das quais participa na vida política e pode-se fazer representar nos órgãos de poder nacional ou sub-nacional. Isto está consagrado na Constituição da República nos n.os 1 e 2 do artigo 46.°, no n.° 1 do artigo 65.°, no n.° 1 do artigo 70.° e n.° 1 do artigo 72.°

O Mau Funcionamento do Parlamento Nacional
Foi adoptada uma declaração como documento do Comité Central da FRETILIN;
A continuar com à violação sistemática do Regimento do Parlamento Nacional e atropelos sistemáticos da Constituição da República, na sequência da subordinação irracional da chamada Aliança da Maioria Parlamentar aos desígnios do auto-proclamado IV Governo Constitucional, o Comité Central da FRETILIN, delega na Comissão Política Nacional, a competência de determinar a renúncia da FRETILIN do Parlamento Nacional, nos termos a definir oportunamente;
Apelar aos deputados das demais bancadas para salvaguradar o estado de direito democrático, preservando a independência do Parlamento Nacional, não permitindo ingerências indevidas e garantindo a separação de poderes.

Alteração a Lei dos Combatentes da Luta de Libertação Nacional:
O CCF deliberou no sentido de se aguardar o desenvolvimento das consultas em curso;
Instruir a Comissão Política Nacional para acompanhar o processo e orientar a Bancada da FRETILIN e os demais intervenientes do Partido sobre a matéria.

As comemorações do dia 28 de Novembro:
1. Decidir a favor da criação de uma Comissão mista FRETILIN/ASDT para preparar e organizar a comemoração do dia 28 de Novembro, a ter lugar, possivelmente, em Aileu
Os projectos do Governo da FRETILIN:

1. Instruir os ex-membros do Governo no sentido de fazer um levantamento detalhado sobre as obras que fazem parte dos planos anuais de acção do Governo da FRETILIN, de modo a se poder divulgar devidamente para conhecimento de todo o povo;

2. Nesta matéria o Comité Central constata que as infraestruturas e outras obras até agora inauguradas pelo auto-proclamado IV Governo Constitucional são ainda resultados do trabalho do Governo da FRETILIN, nomeadmente, os Hospitais de Referência, Sedes dos Sucos, a Estátua de Sua Santidade o Papa Joao Paulo II, a mini-hidroeléctrica de Gariuai, as 5 pontes da costa sul, entre outras;

3. Os subsídios adiantados a favor dos veteranos, dos idosos e dos órfãos não são senão, a realização de um programa maior da FRETILIN, já plasmado na Constituição da República e regulados na Lei dos Combatentes da Luta de Libertação Nacional;

4. O Comité Central concluiu que, a excepção da corrupção generalizada, do nepotismo e da má governação que são da exclusiva iniciativa do auto-proclamado IV Governo Constitucional, todas as actividades que têm beneficiado o povo com pensões, subsídios e as infraestruturas que têm sido inauguradas, são todas a continuidade do programa do I Governo Contitucional ou são hoje possíveis porque o Governo da FRETILIN deixou recursos suficientes para o efeito.

5. A própria fonte de financiamento das desprogramadas, desplanificadas actividades do auto-proclamado IV Governo Constitucional, não são senão, receitas obtidas como resultado de uma negociação bem sucedida e do estabelecimento de instituições credíveis e transparentes, como o Fundo do Petróleo, que são a pedra de toque, nacional e internacionalmente reconhecida, da boa governação do Governo da FRETILIN.

Partido de oposição ameaça sair do Parlamento timorense

Lisboa, 10 nov (Lusa) - A Frente Revolucionária do Timor Leste Independente (Fretilin) ameaçou abandonar o Parlamento timorense até o final do ano, acusando os deputados da maioria parlamentar de cumplicidade com o governo local e de boicote às iniciativas da oposição.

"O Parlamento tornou-se um instrumento do governo, não dando oportunidade à oposição para questionar certos assuntos de interesse nacional, como aconteceu na discussão do Orçamento Geral do Estado deste ano", disse à Agência Lusa o presidente da Fretilin, Francisco Guterres Lu'Olo.

Lu'Olo acusou os deputados da Aliança da Maioria Parlamentar (AMP), liderada pelo Congresso Nacional da Reconstrução de Timor Leste (CNRT), do premiê Xanana Gusmão, de "serem cúmplices do governo", o que tem impedido que o Parlamento exerça as suas funções de órgão legislativo e de fiscalização do executivo.

"Uma maioria pode suportar o governo, mas suportar o governo não é fazer leis contra a Constituição, não é tornar-se cúmplice de um governo que atua fora das leis. Se não corrigirem essas situações vamos abandonar o Parlamento", disse.

A Fretilin, que venceu as eleições de 2007 sem maioria, detém 21 dos 65 assentos no Parlamento Nacional de Timor Leste e não reconhece a legitimidade do Executivo liderado por Xanana Gusmão.

"Se continuar assim, a decisão pode ser amanhã, pode ser depois de amanhã, pode ser daqui a um mês, antes do fim deste ano", acrescentou, se recusando a adiantar uma data precisa.

Mobilização

A decisão foi tomada no sábado, durante uma reunião do comitê central da Frente Revolucionária do Timor Leste Independente (Fretilin), em que também ficou decidida a realização da "Marcha da Paz".

"Vamos mobilizar as massas, os militantes da Fretilin para descerem algum dia", disse Lu'Olo, explicando que a data da passeata depende da conclusão do "reajustamento estrutural" das bases do partido.

O mandato de cinco anos dos responsáveis eleitos para as estruturas locais terminou e a Fretilin está no meio do processo de eleição dos novos dirigentes em 13 distritos, 65 subdistritos e mais de 400 aldeias.

Até agora, foram eleitos 40% dos dirigentes locais e, segundo o presidente da Fretilin, só quando ficar concluído todo o processo é que será definida a data da marcha.

Segundo Lu'Olo, as decisões que saíram da reunião de sábado são a "resposta política" do partido à atual situação governamental.

"As coisas não estão a andar bem. O governo liderado por essa dita AMP não fez praticamente nada e o que se está a verificar é que há má governação, há corrupção, o conluio e o nepotismo pululam nesse governo. Por isso, tomamos esta decisão como uma resposta política", concluiu Lu'Olo.

SMS texts evidence: Minister for Justice Gives Herself And Friends Projects

According to copies of SMS texts acquired by this newspaper, it is evident that SMSs were exchanged between the Minister for Justice and businessmen, in which there were many discussions regarding projects to construct a new fence for the Becora prison, projects were solicited, contacts with international businessmen regarding the acquisition of uniforms for prison officers and other such things.

On the 7th of August 2008, at 12:25:04, before the AMP Government had reached its first anniversary the Minister for Justice received an SMS from her friend JS, containing the following, "Sister, I have just finalized the plans for the project items and I see that the price I informed you of today is enough because this fence is 10 meters high and very thick without using blocks but only cement fill (cement, rock and double layer of steel) International quality. The works are the same as for the USA embassy fence only that theirs is only 3 meters high and not very thick." According to the list of SMSs sent out at 12:30:10 on the same day, the Minister for Justice promised "Good, I will look at it later."

Officially it was only on 25 August 2008 that the Ministry of Finance began to advertise the public tender invitation for the project to construct a new fence for the Becora prison, Project ITB No. RDTL-08-081860101-ITB-812664. "Procurement Services, Ministry of Finance RDTL invites closed bids from those who are eligible to undertake the construction of the new fence for the Becora Prison, in Dili," described the advertisement in the national newspapers.

On that same morning the Minister for Justice asked for financial help from this businessman.

"Good morning J, in fact…..for sure I will phone Her to come and get it from me. Sorry for disturbing you constantly. Thanks," the Minister sent the message to the businessman who won this tender at 11:25:34 hours.

Happily JS, who is the director of the company Marabia Pty Ltd, according to the announcement made by Procurement services on the 2nd of October 2008 was the successful bidder of this project valued at $1,035,333.33, did not leave the minister's words to fall and be lost into the sea between Indonesia and TL. "Good morning sister, tell them they can come and get it, no problem, there is no need to give it back to Herlambang, it will remain between us," Mr. JS sent this SMS from his Indonesian mobile phone number to the Minister for Justice. "Good evening sister, the kids have still not come to pick up this package."

Christian Samson, the director of LABEH, from whom an SMS is also registered in the Minister for Justice's mobile phone says that there has been no change in the incidence of corruption, collusion and nepotism despite PM Xanana strongly avowing to fight against it. "This is an indication of collusion and nepotism because the project was still at an internal stage as it had not divulged publicly so a Minister cannot be engaged in SMS communication with businessmen discussing details regarding a project", Samson said. He explained that, "when there is already an SMS between the Minister and a businessman before the tender being tendered has been officially released to the public then there is favoratism." When this newspaper tried to confirm the SMSs with Mr. Jorge Serrano, director of the company Marabia he asked that his right not to make comment be respected.

On the 7th of August 2008 an SMS was sent from the number 723 0079, during office hours seeking to steal away a project from the Minister. This mobile phone number used by a person who holds a high position in the government wrote, "Good morning sister, help me with some project will you. Thanks."

That afternoon the office of the PM addressed a message to the Minister for Justice, informing her of a signing ceremony for an agreement at the government palace. "Good evening Excellencies, tomorrow Friday 8 August, Mr. PM will be signing an agreement with UNDAF with Finn Reske-Nielsen. Mr. PM asks all of you to attend this signing ceremony, which will begin at 14h30 until 15h30 in the meeting room, PM's Office, Pal Gov. Please dress formally. Thanking you, GPM," this SMS was received in the inbox of the Minister of Justice's mobile phone from the PMs office.

On the 9th of May 2008 an SMS was sent from the Minister's husbands' number 737 4XXX to inform her of the mobile phone number of an international businessman who was visiting Dili. "Roger no. 740 2071," read the SMS. On the previous day this newspaper was able to pay a surprise visit to Mr. Roger Fairbairn at the Hotel Esplanada in Dili, an Australian businessman who has been operating a firm in Indonesia, and who on the 14th of July 2008 sent a message to the Minister saying, "Hi, sorry about the noise, at airport for a flight through to Jkt in 10 minutes. Just to say hello and any news Project? Regards."

The CEO of PT Media Citra International was very confident of winning the Demography Project Contract with the Ministry of Justice worth millions of dollars to digitize the identity card, a project that had once been tendered but was later cancelled because of questions raised about the tender process.

On the same day an SMS was sent by an Indonesian businessman with links to Roger to explain about the price of uniforms. "Boss, I have already spoken with Mr. Americo and I have already given the details needed with the price for 70 pairs; 1) uniform 70 x 200.000…. 14 million 2. Belt 70 x 70.000 … 4.9 million 3. Shoe PDL 70 x 250.000, 250 million 5. Name 70 x 22.000 …. 1,540 million … total 43,190 million. Mr. Americo said that tomorrow morning he will send the money to my BCA, so we can start to order and purchase these things, so by Saturday afternoon it will be ready. Thanks," this SMS was written in Indonesian.

On Friday 10 October this newspaper contacted the number +62 1808311XXX which was answered by a Mr. Irma who confirmed that at the time the Minister for Justice herself personally sent specimens, measurements and color for the uniforms to them. " At the time, Madam….Madam Minister, aahhh….Ms. Lucia, aaahhh….gave details to us. Gave us the details.

Regarding the things that were hers, yes sir. Eeehhh….complete with their attributes. So with the name and other attributes. Like….Sir…like the names, measurements for the clothing, the shoe sizes. At the time Sir, Lucia did this," explained Irma to this newspaper by mobile phone conversation. He said that regarding payment, the Minister paid half of the price before the order was made.

According to the commitment and payment form which this newspaper has been able to access, it shows that MBF Lobato had already authorized payment on the 10th of March this year but did not specify that the amount of US$97,500 was committed for manufacturing of uniforms for Timor-Leste prison guards. The decentralized procurement did not stipulate to which company the money had been paid.

The company that assisted with the manufacturing of the uniforms for the prison guards, had links to Roger Fairbairn who tried to win the Demography Project worth millions of dollars, an who also tried to borrow money from the Minister for Justice and her husband to register his company in Timor-Leste as his staff member named Awie wrote in an SMS on the 9th of May 2008. "Madam. Mr. Americo, firstly I apologized , currently Roger does not have any money in Timor-Leste, maybe Sir can help today and I will pay Sir back", Awie sent an SMS the Minister. On the same day Awie also included an SMS which Roger had sent to ask for money to carry out his activities in Dili. "This is an SMS from Roger: Awie, I need US$1,000 to complete the registration of the company and other administration costs today 1) the translation of the documents 2) pay the government 3) open a bank account. Roger," Awie copied Roger's SMS in English to Minister Lobato.

On the 9th of May 2008 Awie through his mobile phone number +628179991XXX thanked the Minister, "Thank you very much to madam….very sorry for having to inconvenience madam. Awie."

The acquisition process for the TL prison guards uniforms began as early as 9 March this year. On the day before the month of March the Minister for Justice received an SMS which contained information for a bank account number. "Madam this is my BCA no. 2551122XXX in the name of IMANSYAH BUDIANTO," he informed.

On the 14th of March 2008 the minister received from the same number an SMS stating, "Good morning Madam: 1. Price for tailor made pants and shirt RP200,000, - for set tickets coming soon fro 2 people to measure excluding accommodation and meals. 2. Price for hat and bordir: RP20. I ask for confirmation of RDTL LOGO or Badge 3. Belt with RDTL Logo or Badge RP40,000, - 4. Beret I am still checking, Madam these prices all are to arrival in Surabaya, I ask you make correction to prices because I have no experience regarding these prices above."
Accordingly at 428 o'clock in the afternoon the minister answered to +628180311XXX, "Ready. Total price 430 rb. Per person including ticket. Accommodation for 2 excluded. Shoe two examples, 170 rb. Which one are you referring to?" the Minister sent this SMS to the company seeking clarification.

The most recent information regarding these uniforms emerged in an SMS which the minister received on 24 June 2008 which began with a greeting, " Good morning Madam." It followed up, "I ask permission to report on the price of the uniforms and their attributed which together are 123 pairs with the rest from the money which is with Mr. Awi; 1) Uniforms 19,065,000. 2) Copper belt 4,182,000 3) belt KCL 1,783,500, 4)Shoe PDL 17,835,000, 5) Beret 7,011,000, Total 52,582,500, the remainder to be paid 119,407,138, Madam has already paid $1000 (9,200,000) grand total which I ask you to pay 162,789,638, rate 9200/USD……17,695 Madam I ask permission to inform that the Minister's four jackets are ready now. Thanks," Irma said in his SMS which was also received in the Minister for Justice's mobile phone.

According to information the Ministry of Justice has already distributed 198 uniforms to prison guards in Becora Prison and 38 to the Gleno Prison where each person received two sets each.

Despite this, according to sources from the Ministry of Justice, to date the Ministry of Finance does not know which company was awarded the tender.

The Minister for Justice, who is one of the AMP government's most powerful members, is also one who has been accused most often of being involved in corruption, collusion and nepotism. As a member of the 4th Constitutional government the Minister for Justice Lucia B. Lobato has a husband who is a businessman, with whom she has been unable to keep away from allegations of corruption, collusion and nepotism for giving projects to her husband and her friends. On Friday this newspaper obtained information showing that the Minister's husband had contact with a certain businessman. On the 9th of August the Minister attended the office of the Ombudsman for Human Rights to answer allegations regarding the rehabilitation of the Gleno Prison and Becora Prison, after which the Minister told journalists that she wanted "the investigation finished quickly, I ask the Ombudsman to investigate those they feel are important in the investigation, to hear them, compile the evidence in the case, and after the investigation has been completed make a full report to the prosecutorial services if they find indications of corruption and to make their findings public." She also said that she was not scared of facing a court to answer any allegations without hiding behind her immunity.

The AMP government is thinking of and wants to fight KKN, which is why the council of ministers has approved a law creating an anti corruption commission that will report directly to parliament, with strong powers to combat corruption pursuant to the demands of the people.

This intention by PM Xanana Gusmao was reinforced during his speech at the opening of the National Parliament's second legislative session on 9 October when he promised that, "We are not scared of acting, to move to clean up and punish acts of corruption."

"We will not just talk yet again because with empty words we cannot move this country forward."

"The government has taken the initiative of presenting a proposed law that will effectively fight corruption in a totally impartial and independent way and which you will all be able to see very soon, "Xanana promised to the representatives of the people in the Timor-Leste's sacred house.

The fourth constitutional government asked "We have to decide whether we want to just keep accusing and defaming one another to win some kind of political advantage and do nothing good for the people, or do we really want to create the tools which will be effective in wiping out corruption?"

Ramos Horta attacks Aust oil giants

East Timor President Jose Ramos Horta has used an address to the Northern Territory parliament to attack executives at Australia's second largest oil and gas producer, calling them "dogmatic and political".

East Timor is drawing up plans for a pipeline and petrochemicals plant to process oil and gas from the lucrative Greater Sunrise field.

Australian company Woodside Petroleum is on the other side of the high-stakes battle, wanting to build a 530-kilometre pipeline running south to Darwin.

It says laying a pipeline to East Timor would undercut profits and expose supplies to political upheaval.

But Mr Ramos Horta countered the claims during his address to NT parliament today, saying East Timor was less than half the distance Darwin was from the field, estimated to contain $US90 billion ($A107.94 billion) in oil and gas.

East Timor also offered as much security and had more generous tax laws, he said.

"The pipeline should go where ... it is the shortest route and the cheapest.

"Timor Leste cannot and will not bow to pressures of the Woodside CEO millionaires."

Australia currently has about 1,000 peacekeeping forces stationed in the nation and Mr Ramos Horta thanked the government for its "steadfast" assistance.

He also acknowledged the role Darwin played in his recovery from an attempt on his life by rebel soldiers in February this year.

But, he said, the future of East Timor - which became South-East Asia's youngest democracy in 2002 - had to come first.

"Our sincere gratitude cannot be such that we surrender all to Darwin," he said.

In a pointed attack, Mr Ramos Horta called Woodside CEOs "dogmatic and political".

"We will not bow to unilateral decisions made by these CEOs that manage or mismanage multinationals," he said.

The president - who was officially welcomed to parliament with a tri-service military guard - implored Sunrise to explore "all options".

"Woodside seems to think it should be based on patriotic reasons, because Woodside is Australian it should come to Darwin.

"We view it more as a practical and multinational enterprise: it goes where independent, credible scientists recommend it should go...

"Woodside executives are the ones who seem to be dogmatic and political."

Mr Ramos Horta also reminded those present that the gas project would provide a rare opportunity for one of Asia's poorest and smallest countries.

"I love Australia, I feel very much part of it, the blood in my body is Australian, donated by young Australian soldiers," he said.

"But I love my country and people even more...

"You are rich and powerful, so I have to side with my people who are weaker and poorer. I hope you understand this."

The Greater Sunrise field lies almost entirely in territory claimed by both countries and neither can exploit it without approval from the other side.

Under the current licensing agreement the countries have until 2013 to sign a development plan.

THE NATIONAL PARLIAMENT TO DEBATE THE RECOMMENDATIONS OF THE COMMISSION FOR RECEPTION, TRUTH AND RECONCILIATION (CAVR “CHEGA!” REPORT) AND THE BILATERAL COMMISSION FOR TRUTH AND FREINDSHIP (CTF)

On Thursday, 30 October 2008, the National Parliament will hold an extraordinary plenary session to debate the CAVR and CTF reports.

The reports investigate Timor-Leste’s 1975 – 1999 political conflict, determine responsibility for past human rights violations and provide recommendations on how to build a peaceful, stable future for Timor-Leste, paying particular attention to its relationship with Indonesia.

The Parliamentary Committee for Constitutional Issues, Justice, Public Administration, Local Power and Government Legislation (Committee A) will present two resolutions to the National Parliament that recognize the achievements of both Commissions, acknowledge their findings, and propose implementation of their recommendations.

The proposed resolutions highlight CAVR and CTF recommendations in the areas of: victim reparations, a commission for disappeared persons, justice, education and the establishment of an independent institution to oversee implementation efforts.

The debate of the CAVR and CTF reports is an important occasion for the state of Timor-Leste. The National Parliament invites representatives from state institutions and civil society organizations, including the Catholic Church, Media, Political Parties, NGO’s and educational institutions, to observe the debate at the National Parliament on 30 October, 9 am.

Taur Matan Ruak on Fretilin's planned peace march

(TS): A few days ago local newspapers published your words, which caused some people to say that you are interfering too much in politics by getting too close to AMP and to ignore Fretilin. How do you comment to that?


(TMR): I want to make it clear once more than as the chief of the army, I represent an institution which dedicates its whole existence to maximum neutrality and total impartiality. I also want to say that the interpretation made against my words were literal. In other words, I wanted to say that the peace march which people have been talking about has not been put into practice, why are so afraid of it?


I want to also say that our Constitution guarantees the right to everyone to organise demonstrations. But what our Constitution does not allow is violence. If we look at the past, Fretilin's actions have been very good. We can see this in the 2006 crisis. Fretilin mobilised its supporters from the districts to come to Dili but their behaviour at that time was very good despite many provocations.


I congratulate them for this action. Fretilin has also proved a lot through its actions which show that they are against violence themselves. Therefore I believe that even when they do organise the peace march there will be no violence.



Now, as a national institution which is following the developments in the country, naturally we are also worried. We are worried not because Fretilin will use violence when they have (the peace march), but because other people can use this action to cause violence to destabilise the situation in our country, a situation which we all know is still very fragile.


But this does not mean that we will block (the demonstration). To the contrary, our Constitution has shown the way. Simply, what every Timorese want is that there can be no violence just as stated in our Constitution.

UAb organiza o 1º. Simpósio de Educação a Distância dos Países de Língua Oficial Portuguesa

A Universidade Aberta (UAb), sob o Alto Patrocínio de Sua Excelência o Presidente da República, e com o apoio do Secretário Executivo da Comunidade dos Países de Língua Oficial Portuguesa (CPLP), organiza, nos dias 30 e 31 de Outubro, no Auditório 2 da Fundação Calouste Gulbenkian (Lisboa, Portugal), o 1º Simpósio de Educação a Distância dos Países de Língua Oficial Portuguesa (http://www.univ-ab.pt/eventos/simposio_ead/).

O evento contará com a presença do Senhor Secretário de Estado do Ensino Superior de Angola, do Senhor Secretário de Estado da Educação de Cabo-Verde, do Senhor Reitor da Universidade de Cabo-Verde, do Senhor Reitor da Fundação Universidade do Tocantins (Brasil), da Senhora Vice-Reitora da Universidade Agostinho Neto (Angola), do Senhor Presidente da Associação Brasileira de Ensino a Distância, entre outras individualidades.

O programa do simpósio apresentará três conferências plenárias e cinco painéis moderados. As conferências serão proferidas pelo Prof. Doutor Adriano Moreira (Conferência inaugural), pelo Senhor Secretário de Estado Adjunto e da Educação, Prof. Doutor Jorge Pedreira e pelo Prof. Doutor Marçal Grilo (Conferência de enceramento).

Os painéis focarão os seguintes temas: A Educação a Distância como factor de desenvolvimento; Metodologias de ensino a distância na formação de recursos humanos; A educação a distância e a produção de conteúdos em Língua Portuguesa; Um Modelo Pedagógico Virtual na Universidade Aberta; Por uma plataforma de ensino a distância nos Países de Língua Oficial Portuguesa.

“Este simpósio é realizado com o objectivo de proporcionar uma reflexão alargada que congrace instituições de ensino, agentes políticos, empresários, docentes e estudantes em torno da educação a distância, no seio da CPLP - Comunidade dos Países de Língua Portuguesa”, explica o Reitor da UAb, Prof. Doutor Carlos Reis.

O encontro visa também “criar uma oportunidade para o aprofundamento da cooperação entre aqueles países, com destaque para o domínio da educação”, sublinha o Reitor Carlos Reis, acrescentando que a UAb, única universidade (pública) portuguesa de ensino a distância, organiza este simpósio “consciente das suas responsabilidades, uma vez que é uma das instituições que neste campo mais experiência acumulou, ao longo das duas décadas em que tem exercido a sua actividade”.

O Reitor lembra também que cerca de 30% dos alunos da UAb são cidadãos dos Países Africanos de Língua Oficial Portuguesa (PALOP). “Acresce a isto que, nos últimos tempos, a UAb estabeleceu contactos e firmou protocolos com instituições universitárias africanas e brasileiras, directa ou indirectamente empenhadas na educação a distância”.

East Timor opposition plans rally

EAST TIMOR'S Opposition Leader has denied a rally of up to 70,000 anti-government protesters would breach the fragile peace in the South-East Asian nation.

Speaking ahead of his visit to Canberra this week, Mari Alkatiri said he did not believe a demonstration by Fretilin supporters would lead to riots of the kind seen in 2006, in which at least 37 people died.

Fretilin has not named a date for its proposed march.

''The march itself will never destabilise the country,'' he said. ''It is a way for the people to feel free that finally there are free demonstrations without violence ... It is our constitutional right.''

Dr Alkatiri said the purpose of the march was to protest against Prime Minister Xanana Gusmao's ''unconstitutional'' and ''corrupt'' government.

''I think the Government needs to know that people are aware of the corruption. It is time for the people to say something, but peacefully,'' he said.

The Fretilin opposition party maintains it was cheated in last year's parliamentary election, which was overseen by the United Nations.

''We won the election in 2007 and we did not have the opportunity to govern,'' Dr Alkatiri said, adding that the international election scrutineers ''knew Fretilin won the election''.

He is calling for another election to take place next year rather than waiting until 2012 to challenge the Government.

The second secretary of the Embassy of Timor-Leste, Lisualdo Gaspar, said any allegations of government corruption needed to be substantiated by investigations and evidence.

Dr Alkatiri also denied his party was behind pamphlets circulating the capital that allege discrimination is rife within government institutions.

''I think that it is groups that are close to the Government doing this. Xanana is really trying to divide the people,'' he said.

Last week, Defence Minister Joel Fitzgibbon announced Australia would withdraw 100 troops from East Timor early next year, reducing the number of Australian personnel to 650.

Dr Alkatiri said he would like to see all Australian troops removed by the end of 2009.

Dr Alkatiri will give a public lecture tomorrow at the ANU's Finkel Theatre in the John Curtin School of Medical Research, Garran Road, from 12.30pm-1.30pm.
