On 8 June 2007 the Dili District Court conducted a hearing to examine a witness/victim who was presented by the Public Prosecutor. In this hearing the court heard a statement from the witness Cezario da Costa, a member of F-FDTL who was present at the scene of the crime in his capacity as head of security at the residence of Brigadier General Taur Matan Ruak.
In this hearing the Dili District Court only examined 1 witness. The witness claimed that the attack on 24th and 25th May 2006 resulted in injuries to 2 members of F-FDTL. The names of the two victims are Leqilero and Damião. According to the testimony of this witness, members of PNTL and UIR conducted the attack together with armed civilians. Shots were fired from the direction of the school, hospital and from hidden locations behind the hills.
The shooting commenced at approximately 11.00am on 24 May and continued until 5.00pm on 25 May 2006. Just before the shooting took place 2 members of F-FDTL were able to negotiate with the defendant Abilio Mesquita to work together to provide security to avoid conflict between the two factions who were split along eastern-western lines.
As the situation was out of control on the 25 May 2006, the witness and several of his men left the scene at the order of Brigadier General Taur Matan Ruak.
The witness was unsure if Abilio Mesquita and other defendants were involved in the shooting because at that time the witness and a number of his men were hiding in order to avoid casualties. At that time the witness and several of his men also returned fire to prevent a large scale attack on the residence of Brigadier General Taur Matan Ruak.
Based on the observations of JSMP legal researcher Leonidio Marques, on many occasions the witness was unable to understand the questions put forward by the prosecution and defence because the questions were obscure and too long.
In the same hearing the lawyer representing Abilio Mesquita, requested for the court to conduct a further investigation at the scene of the crime to reveal the legal facts and identify the locations used to fire shots at the Brigadier General’s residence. This request was made pursuant to Article 166 of the Criminal Procedure Code on the reconstruction of the crime.
However the court asked for the lawyer’s request to be submitted in writing for the court’s consideration, with a decision to be announced in the following hearing.
JSMP recommends for all court actors to phrase questions to witnesses/victims/defendants in such a way as to avoid confusing them so that they can answer accurately based on what they know, heard and saw.

Em 8 de Junho de 2007 o Tribunal do Distrito de Dili conduziu uma audição para examinar uma testemunha/vítima que foi apresentada pelo Ministério Público. Nesta audição o tribunal ouviu uma declaração da testemunha Cezario da Costa, um membro das F-FDTL que esteve presente no local do crime na sua capacidade como responsável da segurança na residência do Brigadeiro General Taur Matan Ruak.
Na sua audição o Tribunal do Distrito de Dili District Court apenas examinou 1 testemunha. A testemunha afirmou que o ataque em 24 e 25 de Maio 2006 resultou em ferimentos em 2 membros das F-FDTL. Os nomes das duas vítimas são Leqilero e Damião. De acordo com o testemunho desta testemunha, membros da PNTL e da UIR conduziram o ataque juntamente com civis armados. Foram disparados tiros da direcção da escola, hospital e de locais escondidos por detrás dos montes.
Os disparos começaram aproximadamente às 11.00 am em 24 de Maio e continuaram até às 5.00pm em 25 de Maio de 2006. Imediatamente antes dos disparos ocorrerem 2 membros das F-FDTL conseguiram negociar com o réu Abilio Mesquita para trabalharem juntos a fazerem segurança e a evitarem conflitos entre as duas facções que estavam divididas em linhas leste-oeste.
Quando a situação ficou fora de controlo em 25 de Maio de 2006, a testemunha e vários outros homens saíram do local por ordem do Brigadeiro General Taur Matan Ruak.
A testemunha não tinha a certeza se Abilio Mesquita e outros réus estiveram envolvidos nos disparos porque nessa altura a testemunha e alguns dos seus homens estavam escondidos de modo a evitar baixas. Nessa altura a testemunha e vários dos seus homens também devolveram o fogo para evitar um ataque em larga escala à residência do Brigadeiro General Taur Matan Ruak.
Com base nas observações do investigador legal do JSMP Leonidio Marques, em muitas ocasiões a testemunha não foi capaz de compreender as questões que lhe estavam a ser postas pelo procurador e pela defesa porque as questões eram obscuras e demasiadamente compridas.
Na mesma audição o advogado que representa Abilio Mesquita, requereu ao tribunal para conduzir mais investigações no local do crime para revelar os factos legais e identificar os locais usados para fazer disparos contra a residência do Brigadeiro General. Este pedido foi feito sob o Artigo 166 do Código do Processo Criminal sobre a reconstituição do crime.
Contudo o tribunal pediu ao advogado para fazer o pedido por escrito para o tribunal considerar, anunciando a decisão na audição seguinte.
O JSMP recomenda a todos os actores judiciais para porem as questões às testemunhas/vítimas/réus de modo a evitar confundi-las e para que elas possam responder com precisão com base no que sabem, ouviram e viram.
