PETER CAVE: The man accused of inciting much of last year's violence in East Timor goes on trial today, over allegations he illegally supplied high-powered weapons to civilians.
The former Interior Minister, Rogerio Lobato, faces several charges, including the distribution of weapons to a group of former independence fighters with the objective of eliminating the Government's opponents.

ANNE BARKER: Rogerio Lobato still has plenty of supporters despite his heavy fall from grace and the serious charges against him.

Dozens of people turned out at Dili's appellate court a month ago when the trial was originally due to begin shouting "long live Rogerio Lobato".

But the three judges had to postpone the trial when one of Lobato's co-accused failed to show up.

The chief judge rescheduled the trial for today.
It's alleged that in May last year, as then interior minister, Rogerio Lobato authorised the transfer of high-powered weapons to a group of 31 civilians - former freedom fighters - acting under the command of a man known as Railos.
A separate United Nations inquiry has found that Lobato supplied them with 18 semi-automatic assault rifles and 6,000 rounds of ammunition that rightly belonged to a border patrol unit.
Railos has claimed he met Lobato and then Prime Minister, Mari Alkatiri, and was given instructions to eliminate Government opponents, including disgruntled army officers.
He claims that he understood the word eliminate to mean "kill".
It's alleged that later that month Railos and his men took part in an attack on the army in which up to nine soldiers were shot dead.
A few weeks later Rogerio Lobato was forced to resign.
But he's maintained that arming civilians to support the police was entirely lawful under East Timor's Internal Security Act.
And at his first trial hearing a month ago, he showed no signs of stress.

Lobato's lawyer, Paulo Dos Remedios, is confident he'll be vindicated.
PAULO DOS REMEDIOS: Well, the law will prevail. This is East Timor, Timor L'este is a democratic country, it's a state of law, rule of law. The law is for everybody, so, yes, we are confident that we can achieve positive results.
ANNE BARKER: The case against Mari Alkatiri is still unclear.
The United Nations inquiry found there was a reasonable suspicion that the former prime minister at least had knowledge about the distribution of weapons to civilians, and it recommended he face further investigation.
But it rejected allegations that he gave Railos instructions to "eliminate" political opponents.
Prosecutors in Dili have repeatedly questioned Alkatiri, but have not laid charges.

ANNE BARKER: Rogério Lobato tem ainda bastantes apoiantes apesar da sua grande queda em desgraça e das acusações sérias contra ele.

Dúzias de pessoas apareceram no tribunal de apelo de Dili há um mês quando o julgamento estava agendado para começar para gritarem "viva Rogério Lobato".

Mas os três juízes tiveram de adiar o julgamento quando um dos acusadores de Lobato não apareceu.

O juiz presidente re-marcou o julgamento para hoje.
Foi alegado que em Maio do ano passado, então como ministro do interior, Rogério Lobato autorizou a transferência de armas potentes para um grupo de 31 civis – antigos combatentes da liberdade – que agiam sob o comando de um homem conhecido como Railos.
Um outro inquérito da ONU concluiu que Lobato lhes entregou 18 espingardas de assalto semi-automáticas e 6,000 munições que pertenciam a uma unidade de patrulhamento da fronteira.
Railos tem afirmado que se encontrou com Lobato e o então Primeiro-Ministro, Mari Alkatiri, e que lhes foi dado instruções para eliminarem opositores do Governo, incluindo oficiais das forças armadas decepcionados.
Afirma que entendeu que a palavra eliminar significava “matar”.
É alegado que mais tarde nesse mês Railos e os seus homens participaram num ataque contra as forças armadas no qual foram baleados até à morte nove soldados.
Poucas semanas depois Rogério Lobato foi forçado a resignar.
Mas ele mantém que armar civis para apoiarem a policia é totalmente legal sob a Lei de Segurança Interna de Timor-Leste.
E na sua primeira audição há um mês, não mostrou qualquer sinal de stress.

O advogado de Lobato, Paulo dos Remédios, confia que será inocentado.
PAULO DOS REMÉDIOS: Bem, a lei prevalecerá W. Estamos em Timor-Leste, Timor-Leste é um país democrático, é um Estado de lei, de aplicação da lei. A lei é para todos, por isso, sim, confiamos que podemos atingir resultados positivos.
ANNE BARKER: O caso contra Mari Alkatiri não está ainda claro.
O inquérito da ONU concluiu que havia uma suspeita razoável que o antigo primeiro-ministro pelo menos soube da distribuição de armas a civis, e recomendou que ele fosse sujeito a mais investigação.
Mas rejeitou alegações que ele tinha dado instruções a Railos para "eliminar" opositores políticos.
Procuradores em Dili têm questionado repetidamente Alkatiri, mas não o acusaram.
