ANGELITA Pires, the former lover of slain East Timorese rebel leader Alfredo Reinado, says authorities in Dili are depriving her of her freedom because her case is too political.

"I've heard that politically they don't know what to do with me — there is now a lot of support for me on the ground because people are starting to understand the truth and are asking questions," Ms Pires told The Age.

Ms Pires, 38, said she is fed up with being held in limbo, unable to leave East Timor, 11 months after attacks in which President Jose Ramos Horta was seriously wounded and Reinado shot dead.

"All I want to do is to leave," Ms Pires said by telephone from Dili, where a court has confiscated her Australian passport, pending an investigation into whether she played any role in the events that led to the attacks.

"It's going from bad to the ridiculous," she said.

Mr Ramos Horta told diplomats in a new year's address that the motive for Reinado leading a group of armed men to his house remained unknown to him. "The trial of those involved directly or indirectly in the February 11 attack on me and the Prime Minister might reveal more facts," he said.

In his first public comments after being shot, Mr Ramos Horta said Ms Pires was among several people who had "manipulated and influenced" Reinado before the attacks.

In his new year's speech, Mr Ramos Horta said it was feared at the time that the country would slide into civil war.

But he said: "My near-death, like the near death of Mahatma Gandhi when he went on a long hunger strike, pushed back the people from the brink of a wider conflict."

Ms Pires said she had been warned by "high people" to stop speaking with journalists about her plight. An application she made to a court in Dili to be able to travel to Darwin for 10 days to see her family for Christmas — and for medical reasons after losing a baby she had conceived with Reinado — was refused.

"I have come to the stage of my life where I am fed up with being in limbo — is there anything to charge me with?" she said.

Ms Pires said until Mr Ramos Horta apologises and "says what he said about me was completely wrong, I will not feel safe in Dili".

She is living in a shack in a Dili suburb, unable to get access to her bank accounts, which authorities have frozen.

Her food is provided by her family.

In Australia, Ms Pires' brother, Antonio, and mother, Maria Francisca Pires, have told Australia's Foreign Minister Stephen Smith that she has not received fair representation in East Timor.

"You and DFAT (Department of Foreign Affairs and Trade) have made it clear to us that we, as migrant Australians, are not afforded the same rights as born Australians," they said in a letter dated December 25.

CANBERRA - One of the world's highest concentrations of dolphins and whales -- many of them protected species -- has been discovered off the coast of East Timor, local and Australian researchers said.

A "hot spot" of marine cetaceans migrating through deep channels off the Timor coast, including blue and beaked whales, short-finned pilot whales, melon headed whales and six dolphin species was uncovered in a study for the Timor government.

CAMBERRA, Austrália (Reuters) - Uma das maiores concentrações de golfinhos e baleias - incluindo muitas espécies protegidas - foi descoberta perto da costa do Timor Leste, disseram pesquisadores locais e australianos na quarta-feira.

Um "ponto de encontro" de cetáceos marinhos migrando pelos canais profundos da costa do Timor -incluindo baleias azuis, baleias-bicudas, baleias-piloto-de-aleta-curta, golfinhos-cabeça-de-melão e seis outras espécies de golfinhos- foi descoberto em um estudo do governo do Timor Leste.

"Estamos impressionados com a abundância, diversidade e densidade dos cetáceos. A maioria é protegida", disse a cientista que comanda o projeto,
Karen Edyvane, em entrevista à Reuters.

"É um dos principais pontos de encontro de cetáceos do mundo", disse ela.
O estudo foi conduzido por pesquisadores do Timor Leste e especialistas do Instituto Australiano de Ciência Marinha, trabalhando em uma embarcação de madeira tradicional da Indonésia, de 20 metros de comprimento.

A pesquisa destacou a ameaça representada pela pesca desregulamentada na região. O Timor Leste, um país pobre, está tentando desenvolver o seu setor de pesca, ao mesmo tempo em que busca oportunidades para seu setor de turismo, como o turismo baleeiro.

Em apenas um dia, mais de 1.000 cetáceos e talvez até 2 mil baleias em oito grupos -cada um com até 400 mamíferos- foram avistados em uma área de 50 quilômetros de oceano, disse Edyvane.

EAST Timor has lashed out at a UN report that labels the country's police and judicial systems as dysfunctional.

A statement released by the Government in Dili at the weekend questioned the authenticity of the report and accused The Australian of waging a "campaign of disinformation" against Dili.

The UN report, revealed in The Weekend Australian on Saturday, appeals for urgent action to fix the East Timorese police and judicial systems, warning that the struggling nation could revert to anarchy.

The government statement released on Saturday accused unnamed "political and geo-strategic" interests of being behind the leaked UN report.
East Timor's internal security situation was "perfectly normal", said the statement from the Xanana Gusmao-led Government. "Thus, the alleged report did not come from the UN. Once again we are dealing with speculation, other interests and even worse whose aim is achieving certain objectives, political, economic and geo-strategic," it said.

Mr Gusmao and President Jose Ramos Horta are understood to be angry over the report's findings, which paint anunflattering picture of political disunity in East Timor's upper echelons.

Their anger is easily understood as the report recommends generational change among East Timor's political elite.

"To achieve more fundamental stability, it would be vital to focus on considerably enhancing political institutions, particularly the parliament, and invest an extra effort in grooming a second line of national leaders,"
the report says.

The report, dated December 1, has been independently verified as genuine by the UN after two senior officials contacted The Australian last week seeking details of this newspaper's plans to publish excerpts from it.

It was prepared by UN Assistant Secretary-General Dmitry Titov from the Department of Peacekeeping Operations and covered an official visit to Dili and Canberra from November 22-29.

During the visit to Dili, which focused on security sector reforms, Mr Titov met Mr Gusmao and Mr Ramos Horta, and senior officials in the UN Mission in East Timor for talks on "the resumption of policing responsibilities by the PNTL (Timorese police)."

Questões políticas, económicas e sociais podem gerar nova crise

Timor-Leste está no bom caminho para a paz e estabilidade, afirmava na semana agora finda o número dois da missão das Nações Unidas naquele país, Finn Reske-Nielsen.

Uma apreciação que pode ser considerada optimista, em especial quando surgiam na imprensa australiana extractos de um documento confidencial da ONU com observações contrárias.

"Penso que os timorenses podem considerar-se orgulhosos do que foi conseguido este ano e terem a certeza de conseguirem ainda melhores resultados em 2009", insistiu Reske-Nielsen. Olhando o passado recente, a dúvida é, de facto, se os timorenses têm condições para ultrapassarem o actual impasse.

Em relação a Fevereiro de 2008, quando se verificaram os acontecimentos de que resultaram a morte do ex-major Reinado e o atentado à vida de Ramos-Horta, a situação parece tranquila. As principais forças políticas têm moderado o tom das acusações, mas relatos sobre a situação no território indicam viver-se um momento de tensão adiada.

Por outro lado, permanecem visíveis os efeitos da crise de 2006, e que vai culminar no surto de violência de 11 de Fevereiro de 2008. Continuam por realojar milhares de deslocados, dispersos por 16 campos. O Governo anunciou a intenção de encerrá-los até Fevereiro, mas os deslocados regressam, em muitos casos, a localidades onde as suas casas e infra-estruturas foram destruídas.

O clima económico internacional não é de molde a encorajar o investimento num país que necessita deste de forma urgente.

As ONG têm alertado para tensões resultantes do movimento das populações. Estão identificados conflitos sobre direitos de propriedade, tensões entre deslocados, que receberam subsídios, e aqueles que, tendo permanecido nas vilas ou aldeias, não receberam verbas oficiais. Por último, as tensões políticas entre apoiantes dos vários grupos continuam presentes numa sociedade em que não se concretizou ainda a total reforma do sistema de segurança e de justiça e o enraizamento de uma cultura de relacionamento político e institucional está longe de existir.

O Governo de Timor-Leste garante que o relatório publicado na Imprensa australiana sobre a situação de "anarquia" no país não é - ao contrário do noticiado - da responsabilidade das Nações Unidas.

O jornal "The Australian" divulgou na sua edição de terça-feira o conteúdo de um alegado relatório "confidencial" da ONU, que alerta para o facto de a situação de "anarquia" em que se encontra Timor-Leste poder resultar na reedição dos distúrbios que dividiram o país em 2006.

O relatório fala de forças de segurança "disfuncionais", um sistema de justiça "caótico" e um poder político "dividido", acrescentando que o país apresenta "funestos" problemas sociais e uma economia em "queda livre".

"O alegado relatório não partiu da ONU e trata-se, mais uma vez, de se alimentarem especulações, com outros interesses, tendo como finalidade atingir determinados objectivos: políticos, económicos e geoestratégicos", refere um comunicado do gabinete do primeiro-ministro de Timor-Leste. Nele, Xanana Gusmão considera que a publicação da notícia reflecte o facto de haver quem queira que o país volte ao caos, e destaca a avaliação "positiva" da evolução da situação feita por organizações internacionais como a UNPOL, ISAF e a missão da ONU em Timor-Leste (UNMIT).

"De acordo com UNMIT a situação interna em Timor-Leste em 2008 é perfeitamente normal", adianta o comunicado.

Após a notícia, o representante especial interino do secretário-Geral da ONU para Timor-Leste, Finn Reske-Nielsen, esclareceu que a situação no país "é calma e pacífica".

"As ruas de Díli e o resto do país estão calmos e pacíficos. Tem havido avanços sólidos na governação democrática e no respeito pelos Direitos Humanos. O Parlamento está a exercer o seu papel de uma maneira cada vez mais activa e o diálogo entre os partidos políticos sobre questões de importância nacional é robusto e construtivo", disse Finn Reske-Nielsen.

"Do ponto de vista da UNMIT, podemos dizer claramente que estamos muito contentes com o progresso que foi feito em Timor em 2008", sublinhou.

Relativamente às falhas apontadas no referido relatório, Xanana Gusmão garante que existe "funcionalidade entre as estruturas policiais" e que o país vive em condições de estabilidade e segurança "normais".

A respected newspaper in East Timor has been charged with defamation over a series of stories it published accusing the country's Justice Minister of corruption, collusion and nepotism. The newspaper's director, Jose Belo, says he's prepared to go to jail to defend his publication.

MARCH: East Timor's prosecutor-general is bringing a defamation action against the Tempo Semanal newspaper, based on a series of articles it published concerning alleged activities of the Justice Minister. In October, the newspaper accused Justice Minister Lucia Lobato of engaging in corruption, collusion and nepotism during the issuing of a number of government tenders. The reports were based on alleged SMS communications.

Tempo Semanal's director Jose Belo has been a journalist for 13 years, and has worked for a number of international news organisations including the ABC and Associated Press.

BELO: We are not simply just trying to, accuse a minister or defame a minister, but because she is a minister of the justice, this is really in the interest of the public.

MARCH: The government passed a new penal code that decriminalises defamation, however the president hasn't promulgated it yet. That means Jose Belo is being charged under the Indonesian penal code, which considers defamation to be a criminal act. If found guilty he could be fined, or sent to prison. Jose Belo fears the minister is exploiting his limited budget and resources.

BELO: You know the Tempo Semanal is a very poor newspaper in this country - we don't have any money or any resources. So we can't fight a person who has influence [and] who has money. So I presume it is very, very difficult to win this case in the court.

MARCH: In a written response to Radio Australia, Lucia Lobato stated she feels the articles were hurtful and have discredited her both personally and professionally. She says she supports free and fair media, but also supports accountability and responsibility in reporting. Minister Lobato stated she would accept any verdict handed down by the court.

Despite the prospect of jail time, Jose Belo says he'll fight the charges.

BELO: If I just give up, to this kind of attitude by the government it seems likely that I am going to give away to the government to shut down the media here, and it is really bad for the independence of media in Timor-Leste. So I am committed to go and fight in the court, with the evidence we have, based on the evidence we publish these stories.

MARCH: Jose Belo fears the action against his newspaper will discourage other media organisations from investigative reporting.

BELO: I think the other media is very, you know, self-protective. They don't really want to go after this investigative reporting because they know the risk. And I myself understand this risk. But you know we have to come out. If we are serious media we have to come out.

MARCH: Justice Minister Lucia Lobato is a member of the Social Democratic Party - or PSD - one of the members of the coalition government led by Xanana Gusmao. Mario Carrascalao is an MP and member of PSD. He says while he is certain there is corruption in some government departments, he doesn't believe Minister Lobato is guilty of any wrongdoing, but he too says the case could have a negative impact on press freedom.

CARRASCALAO: Of course it sounds not good because this also will prevent some journalists to have the courage to publish what they know, and to stop corruption here we need in fact, how do you say, the press to be really open and to publish everything they know about the wrongdoings made by officials here.

MARCH: A number of corruption allegations have been made against East Timor's government over the past twelve months. The opposition has called for Minister Lobato and a number of other government officials to be sacked in light of the claims, however the only action taken so far has been the charges against the Tempo Semanal newspaper.

During his time as both President and Prime Minister, Xanana Gusmao has spoken often for the need for media freedom and transparency in government. Jose Belo says his words have not translated into action to deal with the growing problem.

BELO: Until today is very, very little action has been taken to investigate these cases, and I am apessimist - I'm very, very pessimistic that Xanana will be taking these actions against these ministers.

MARCH: The Prime Minister is developing a new anti-corruption commission. The government hopes it will start functioning in 2009. Mario Carrascalao says it would be impossible to eradicate corruption entirely, but has high hopes the commission will make a big difference.

CARRASCALAO: I believe in one year, two years, corruption will come to a level. It will never be acceptable, but a level that would be reasonable for a country just like ours that doesn't have skilled people and even without mechanism to prevent corruption to happen.

O comunicado refere ainda que a existência de problemas judiciais não é exclusiva de Timor-Leste e que as divergências políticas são "naturais em democracia" e "não contribuirão para uma eventual anarquia".

Adianta ainda que a crise financeira tem afectado todo o mundo e que "o Governo de Timor-Leste criou um Fundo de Estabilização Económica (FEE) para responder à crise actual e a outras que eventualmente a sucedam".

Gostaria de aproveitar este blog para fazer uma denúncia:

Trata-se da escandalosa circular que foi posta pelo Ministro NE Zacarias no Ministério dos Negócios Estrangeiros a solicitar que todas as passagens aéreas têm que ser compradas numa agência de viagens cujo custo é, em geral, 3 VEZES SUPERIOR ao valor do mercado e das outras agências de viagem porque, alegadamente, oferece melhor serviço... O mais engraçado desta história é que, por coincidência (ou não…), o Sr. Ministro Zacarias é um dos proprietários desta agência de viagens!!!
Dou um exemplo muito simples: numa visita oficial ao Irão o custo, no mercado, de um bilhete de avião é de aproximadamente 2000USD enquanto o mesmo bilhete adquirido na agência de viagens do nosso Exmo. Ministro custou 6000USD! Agora multipliquem este valor pelo número de membros da comitiva e tentem saber quantas viagens o MNE faz por ano.
Como cidadão timorense não deixo manifestar a minha preocupação porque, enquanto o nosso povo sofre de fome e miséria, com elevadas taxas de mortalidade infantil, alguns líderes esbanjam o nosso precioso dinheiro para, no final, terem benefício próprio. Poderá dizer-se que é mais um dos casos de “abuso de poder”, “tráfico de influências “, “má gestão do dinheiro público”, “concorrência desleal”, etc. Já nem falo de corrupção (embora já esteja na “boca do povo” que este governo é muito corrupto…) porque queria acreditar que não há corrupção em Timor-Leste.

Contestem! Investiguem! Que se faça justiça!

Realmente, não se pode tolerar tanta falta de respeito a um Primeiro-Ministro de um Governo legítimo e democraticamente eleito!

Eu sei que o Povo, simples, humilde e sofredor, vai compreender com clara noção dos seus deveres e obrigações de cidadania, esta IMPOSIÇÃO DE RESPEITO AOS SEUS LEGÍTIMOS GOVERNANTES!

Vou também recomendar ao Primeiro-Ministro, do actual Governo inconstitucional, para apressar com a Lei da Liberdade da Imprensa. [...] Contem comigo, porque enviarei de volta a Lei, para ser corrigida no título que deverá ser: Lei da Censura!

RELATÓRIO PODE IMPLICAR XANANA NA VIOLÊNCIA DE DÍLI

O Presidente Xanana Gusmão poderá vir a ser esta semana implicado pelas Nações Unidas na violência que ocorreu em Timor-Leste durante os meses de Abril e Maio, e que se saldou num número ainda indeterminado de mortos e feridos, provocando uma onda de milhares de refugiados no país.

Em causa estão as ligações pouco compreensíveis de Xanana Gusmão a alguns dos principais responsáveis pelos diferentes episódios de violência que levaram à demissão do primeiro-ministro Mari Alkatiri, substituído no cargo por José Ramos-Horta. Nomeadamente os que envolvem o Presidente numa teia de contactos e até de protecção aos majores Alfredo Reinado, Marcos Tillman e Alves Tara, passando pelo "Comandante Railós" (nome de guerra de Vicente da Conceição) e pelo antigo n.º 2 da polícia de Díli, Abílio "Mausoko" Mesquita.

Suspeitas que têm vindo a ser objecto de diferentes reportagens nos principais jornais australianos e que explicam, de alguma forma, as razões que levaram o próprio Xanana a alertar os timorenses para a hipótese de este relatório poder vir a constituir um "fardo pesado" para o país, implicando dirigentes políticos e muitos dos responsáveis pelo aparelho de segurança em Timor-Leste. Especialmente ao nível da polícia (PNTL), estrutura que hoje se encontra praticamente desarticulada.

Apesar disso, e de o jornal australiano The Age ter referido este fim-de-semana que o relatório da ONU poderia vir a responsabilizar cerca de cem pessoas pelos acontecimentos, tudo indica que a ONU acabará por divulgar uma versão mais suavizada dos factos apurados pelos três investigadores designados pelo secretário-geral Kofi Annan: o brasileiro Paulo Sérgio Pinheiro, a sul-africana Zelda Holtzman e o britânico Ralph Zacklin.

Quanto mais não seja pelos receios que a divulgação - sucessivamente adiada - deste relatório parece inspirar em Timor-Leste, onde a situação está longe de estar controlada pelas forças internacionais, como se constata pelos incidentes que ali ocorrem diariamente.

Situação de "anarquia" pode reeditar distúrbios - ONU

Sydney, Austrália, 23 Dez (Lusa) - A situação de "anarquia" em que se encontra Timor-Leste pode desembocar na reedição dos distúrbios que dividiram o país em dois em 2006, causando mortos e desalojados, segundo informação confidencial da ONU publicada hoje por um jornal australiano.

Nesta informação pede-se que as forças de paz internacionais se mantenham no país para evitar o caos da nação, alimentado por uma polícia "disfuncional", um poder político dividido, que apresenta "funestos" problemas sociais e uma economia em "queda livre", segundo o diário The Australian.

"Quanto às instituições de segurança, não há decisões fáceis. Os doadores deveriam preparar-se para providenciar uma nova assistência enquanto pressionam o executivo para que cumpra as suas obrigações", diz o texto, concluído a 01 de Dezembro e que tem como objectivo avaliar a conveniência da continuação das forças de paz no país.

"Continuam a existir tremendas falhas, incluindo uma débil liderança e controlo do poder, falta de capacidade de logística e de alimentos", acrescenta a informação "muito crítica" sobre a situação do país, nove anos após o fim da ocupação indonésia e seis sobre a independência.

Em Fevereiro, o Presidente da República, José Ramos Horta, foi alvo de uma tentativa de assassínio e teve de receber tratamentos médicos na Austrália, enquanto o primeiro-ministro, Xanana Gusmão, escapou ileso a outro ataque na mesma ocasião.

Mais de 2.500 agentes de segurança estrangeiros continuam em Timor-Leste, a maioria proveniente da Austrália, Nova Zelândia e Portugal.

Excellency,
Comrade,

You have known me and my family since, well since before I was born. You may remember me as that little nholuene (street kid) running bare-foot in the slums of Maputo. That rascal that used to steal mangoes from distinguished members of both FRELIMO’s and FRETILIN’s Central Committee, in carefully planned and synchronized raids with other street kids.

Well I have grown slightly since then, moved to Dili after the restoration of our independence and since then I am willing to write to let you know of my current “whereabouts” and the situation of our beloved environment.

For too long I have remained in silence, your Excellency.

I believe I have been fortunate as I was one of the few hundred of Timorese that was given the opportunity to study abroad, sent to the great island down south. While I was in the “land down under” I did my best to study and learn from the best in an under-budgeted School of Zoology, from my mentors, close friends, the myriad of putative researchers and from a truly jovial character that is still to finish his PhD.

I feel that I would be betraying every single one of them if I was to remain in silence; I would be betraying my forefather and those “long haired youngsters” (the ones baptized as “ideological terrorists” such as yourself) that have started this country and tirelessly fought for our independence.

As your Excellency may be aware, the government appointed by you to govern this great Maubere Nation of ours has signed an MoU to plant sugarcane in Suai, Viqueque, Manatuto and Lospalos.

It is not my intention to question neither the legitimacy of this government nor the legitimacy of your choice, however, Comrade President, I have no quandary pointing out that the dim-witted decisions of the current Government are an impediment to any faint ideas that your Excellency may still hold of sustainable development for Timor-Leste.

This current Government has, under your watchful eyes, signed a dubious(1) MoU presenting the government’s intention in granting 6/10 of Timor-Leste’s total arable land (2) and nearly 90% of Timor-Leste’s arable flatlands and plains (3) to plant sugarcane.

It is commonsense that this project poses significant threats to our food and water security and, presents itself as a threat to the sustainability of Timor-Leste as a sovereign nation and yet you have not come forward and spoken up.

The product of this sugarcane plantation is meant to produce bioethanol that is meant to power cars at the other end of the world, this project will simply nourish egos of several hundred “eco gluttons” while Timorese starve by the thousands because their land was taken away from them, and their economic freedom. The unwary Maubere and Buibere are at the dawn of eminent starvation. Those that say they are eco-friendly, actually have ecological footprints that would make big foot look like an infant.

Excellency, I would like you to engage in this little game of mine called “I will remember before I forget”. In this game I will remind you of the key parts of your “A vision for our beloved country” speech and explain why I believe that, while I don’t take you for a mal intended politician, your vision has faded, eroded and is at a stage of delusion.

The first quote I have picked from your “A vision for our beloved country” was:

“We must remember that Timor-Leste is a relatively arid island with few rivers and lakes. With population growth the available land and water will shrink further in the next 20 years.”

I am sure that even though arithmetic, calculus, and mathematics may not be your forte the land area concerns raised by National Parliament were very didactic, they even had examples of how much 100,000 hectares are measured in “soccer fields” for a mathematic illiterate. Granting 6/10 of the arable land will accelerate even further to what you refer to as “shrinkage” of land, and furthermore I am sure that your team of able and well paid international Environmental Advisers must have told you that sugarcane plantations required bountiful amounts of water, use of a plethora of chemicals that poison the very environment that you have said you are willing to protect. Not only will this project upset the biodiversity and the ecological equilibrium of several habitats and ecotones but it would further eat away traditional ecological and agricultural knowledge of several ethnolinguistic groups and would configure the diverse local knowledge, shaping their culture into a monoculture, much like the plantation.

I am not aware if your team of respectful Environmental Advisers and skillful Ministers has briefed you on the Company’s “brilliant” idea of creating a series of water reservoirs, and their plans to use copious amounts of pesticides, herbicides and fertilizers that are bound to:

1. pollute wetlands of national significance,
2. destroy important bird areas,
3. destroy the refuge for a series of migratory birds,
4. wipe out unique species, a reminder of evolution (4)

Surely they would have told of the detrimental environmental implications reservoirs would have on environmental flows, the unique ecosystems (5) of the South coast and on the livelihoods of the people (who will be devoid of using water in such structures).

Your Excellency, your Government has proposed to grant 6/10 of the arable land for a period of 50 years, now do you believe that this is socially viable? If you think of “Food security” how unsecure would we be granting away 6/10 of our arable land to a foreign company?

Do you truly believe in the sustainability of this project?

You are meant to be the President of the poor, this project will indubitably shatter the livelihoods of thousands, where is your pro-poor policy now?

I strongly believe that the sugarcane project contradicts what you have written in your so-called “Vision for our beloved country” and yet your lips have remained sealed, you have become powerless, impotent to fight this regime that throws our people to live in slums, while the government acts as a canteen in the name of food security; buying rice, taxing it, and then reselling “making a killing” in profits and exploiting our martyred people.

By remaining in silence you have unwillingly acknowledged that you have lost the inner drive for your vision for our beloved environment, is it lost or hidden in the remote recants of your troubled soul?

I here question your environmental concerns your Excellency. It is not enough to watch “An inconvenient truth” and write a couple of lines on your speeches saying that you care for the environment, if the “drive” is wrong, if the belief is not there, you are just an environmental charlatan.

Going back to your speech, you have eloquently said:

“I advocate the launching of a major land, water and forest preservation program to save our land and create jobs.”

Despite this being a major land and water project, I do not believe this is a “land saving” project. If we look at the experiences of other brotherly nations (Brazil, Mozambique) that have planted sugarcane plantations have had detrimental impacts to their people, flora, fauna and geomorphology.

I was the first to debunk the fallacious ideas presented by your government that this project would generate 10,000 jobs with facts and figures and taken from several academic papers. I have also publicly discredited some of the social and environmental benefits anticipated by the government (6). I have presented data showing that in fact, this project would threaten some 20 plus important bird species.

It is un-Timorese of you, your Excellency to remain quiet in this time of need, as you have sworn:

“To protect the environment and to preserve natural resources” (Constitution Article 6, line f).

By remaining in silence you have pilfered the Maubere Peoples “(…) right to a humane, healthy, and ecologically balanced environment” and of their “duty to protect it and improve it for the benefit of the future generations.” (Constitution Article 61).

Given that vast amount of information points out that this project is likely to change and even destroy several ecosystems and, since the utilization of the natural resources in Timor-Leste should preserve “the ecological balance and prevent destruction of ecosystems” (Article 139, line 3), why have you chose to remain quiet?

Environmental concerns surpass political ideologies and the pre-election alliances have biased your judgment. I should point out this “willing but not so able government” has repeatedly misinterpreted the writings in our constitution, to benefit foreign “entrepreneurs”, mouthpieces of multinational companies that come here to make an easy buck, due to your ludicrous tax incentives that have brought about the collapse of our environment.

Excellency, thus far you have but “raised my limitations”. You have compromised your status of independence when you defended the in-defendable (7), closed your eyes to the obvious (8), and quietly allowed mayhem to settle in Government.

While you were swift in expressing your disgruntlement for the Peace Rally, as in your words, it would put at stake the legitimacy of the current government, and by default the government of your choice, you are still to speak out on matters of the environment.

Sometimes I find myself asking the same question that my judicious and poetic lecturer of Evolutionary Biology and Biogeography asked, “does it really matter?” By God, your Excellency it does, this truly matters your Excellency.

In fact, perhaps I should again remind you that in this coming age, any disregard for the environment can prove to be costly to our people and Nation, as well as to the image of those who govern and still dream of having a “greater vocation (9)”.

After signing the MoU the government (that you have “hand-picked”) has chosen to turned a blind eye to our constitution, the subsidiary legislation applicable in Timor-Leste, and the international environmental agreements signed and ratified by Timor-Leste.

I have stated loud and clear that this MoU is environmentally unsound and have disseminated this information in National Parliament; however, the National Parliament’s ability to take the due course of action has been limited due to the ceaseless introgressions of the Government in National Parliament and the judiciary alike (10).

In terms of subsidiary legislation the government “forgot” to follow the subsidiary legislation such as: Law number 23/1997 on environmental management, Government Regulation 53/1993 on environment impact assessment, Government Regulation 20/1999 on control of water pollution.
Furthermore if this project goes ahead this is a clear violation of several United Nation Conventions.

I would like to ask your Excellency to call upon a and environmental impact assessment of this project, a cumulative impact assessment (line f Government Regulation 53/1993) and additionally I would appreciate it if you could natter to your Ministers, strike a chord, tell them to cease the intimidations to the first newspaper (11) that has published some of these environmental concerns.

The Minister of Justice launches attack on Tempo Semanal.

Potentially a precedent setting use of the Democratic Republic of
Timor-Leste's anti-defamation law by a senior member of the Government
against the free press in Timor-Leste.

Dili, Timor-Leste, 18 December 2008 – In a widely anticipated move, on
12 December 2008, the Office of Prosecutor-General served notice to
the Tempo Semanal weekly newspaper that it is to appear on 19 January
2009 to answer defamation charges brought against Tempo Semanal by
Lucia Lobato, the Minister of Justice. When asked by Tempo Semanal to
be given a copy of the charges the Office of the Prosecutor-General
stated that this would be impossible seeing as the relevant documents
were confidential. Thereby depriving Tempo Semanal of due process, and
this is only the beginning.

On 12 October 2008 Tempo Semanal published a story alleging acts of
corruption regarding Government contracts by the Minister of Justice.
The story can be viewed in Tetun at this link; and in English at this
link. These were based upon a series confidential interviews and a
large number of text messages sent and received by the Minister of
Justice on her publically financed Government mobile phone. The
content of these messages was made available to Tempo Semanal by a
confidential source. Tempo Semanal intends to protect its sources.

These messages were sent and received by a Government phone used by
the Minister of Justice, paid for by the State of Timor-Leste, and are
therefore the property of the people of Timor-Leste. These messages
indicated that there were strong suspicions that the Minister of
Justice was providing inside information and indeed possibly
favourable conditions to business people in Indonesia and Timor-Leste.
The contracts involved Ministry of Justice projects relating 1) to
renovation of the Becora Prison perimeter wall, 2) uniforms for the
prison service [insert video] and 3) the design, issuance and
management of national identity documentation. The relevant stories

A subsequent attempt by Tempo Semanal on 16 October 2008 to obtain
clarification on the alleged corruption were met by refusals by the
Minister of Justice to grant Tempo Semanal an interview – view the

Tempo Semanal has also uncovered allegations of corruption against
Americo Lopes, the husband of the Minister of Justice, and owner of

Tempo Semanal has received veiled threats by members of the Government

if it chooses to continue reporting on corruption; likewise it has
also received words of encouragement by the members of government, the
opposition and wider civil society to continue. While Tempo Semanal
does not have the same resources at its disposal as the Minister of
Justice it intends to defend its sources, and the position of the free
press in Timor-Leste – to the full extent of the law - such as it is
in Timor-Leste. Tempo Semanal will not accept money from the
Government to run away to another country and therefore avoid the
judicial process.

Alternativa: Ministra da Justiça de Timor-Leste em rota de colisão com
o Tempo Semanal Um caso sem precedente inicia-se hoje em Timor-Leste
em que membru senior do Governo faz uzo da lei da difamação como forma de coagir a liberdade de imprensa nesta nova democracia.

Dili, Timor-Leste, 18 Dezembro de 2008 - O Gabinete do Procurador
Geral, numa já antecipada acção notificou o jornal Tempo Semana no dia
12 de Dezembro de 2008, dizendo que o jornal terá de marcar presença
no tribunal no dia 19 de Janeiro de 2009 para responder à acusação de
difamação levantada pela Sra. Lúcia Lobato, Ministra da Justiça,
contra o Jornal Tempo Semanal. Quando jornal Tempo Semanal pediu ao
Gabinete do Procurador Geral para facultar aos documentos da acusação,
o Gabinete respondeu de forma negativa, visto que, nas palavras
Gabinete do Procurador Geral o documento de acusação era confidencial.
Esta é a primeira de uma série de acções que roubam ao Jornal Tempo
Semanal a possibilidade de saber as bases da acusação, deprivando
assim o Tempo Semanal da contrucção de um caso de defesa.

No dia 12 de Outubro de 2008 o Tempo Semanal publicou um artigo onde
alega a existência de corrupção e má administração em alguns dos
contratos públicos do Governo, em especial, contratos públicos
relacionados com o Ministério da Justiça. O artigo pode ser acedido em
lingua inglesa e Tétum através dos links . e . Os artigos foram
escritos com base em uma séries de entrevista confidenciais e num
diverso número de mensagens enviadas e recebidas pelo telemóvel
Oficial de S.Exa a Ministra da Justiça.

O conteúdo desta mensagens foi faculdata ao Jornal Tempo Semana
através de uma fonte confidencial. O Jornal Tempo Semanal continuará
como sempre a proteger a sua fontes.

Estas mensagens foram enviadas através do número e do telemóvel
oficial da Ministra da Justiça, cujas contas são pagas pelo Estado
Timorense, logo, são propriedade de todo o povo de Timor-Leste. Estas
mensagens acrescem às fortes suspeitas que a Ministra da Justiça tem
fornecido informação a empresários Indonésios com intuito de favorecer
a entrada de empresários Indonésios em Timor-Leste. Os contrados
envolvendo a Ministra da Justiça são os da 1) renovação do muro da
prisão de Becora, 2)fornecimento de uniformes para a os guardas prisionais 3) design, emissão e gestão dos documentos de identidade nacional. Todos os artigos podem ser lidos e acedidos no site do Tempo Semanal.

No dia 16 de Outubro de 2008, o Tempo Semanal tentou obter mais
informação e uma resposta da Ministra sobre o caso de alegada
corrupção, mas infelizmente a Ministra recusou a conceder uma
entrevista ao Tempo Semanal o video da tentativa de entrevista

O Tempo Semanal preparou também uma peça sobre o alegado caso de
corrupção contra o Sr. Américo Lopes, marido da Ministra da Justiça, e

Apesar do Tempo Semanal não disport dos mesmo recursos que a Ministra da Justiça, o Tempo Semanal defenderá as suas fontes, a continuará sempre a defender a necessidade de um imprensa livre e justa em Timor-Leste, com base na lei que vigora no país.

Death threats after E Timor graft claim

AN Australian businessman in East Timor says he has received death threats after he questioned an allegedly corrupt $3.1 million government fuel contract.

Jack Salatian, a director and shareholder of Sunshine Petroleum, said he was threatened after questioning the awarding of a fuel contract to a rival bidder offering diesel fuel to the state electricity provider at US6c a litre higher than his bid.

The Pualaka Petroleum company, owned by Americo Lopes, the husband of East Timorese Justice Minister Lucia Lobato, was awarded the contract - a decision that led to widespread corruption concerns in Dili.

Ms Lobato is suing Jose Belo, managing editor of the weekly Tempo Semanal, for defamation after the newspaper ran a story that raised serious questions about the contract.

The row underscores claims of increasing corruption in Southeast Asia's poorest country - much of it allegedly linked to ministers and their spouses.

Mr Belo claims the contract smacks of favouritism. He told The Australian the grounds for awarding the tender were even more questionable, given Mr Lopes lacked funds to purchase the diesel fuel intended for the state electricity provider EDTL.

Instead, he was issued a Treasury letter of credit for $US3.1million, a copy of which has been obtained by The Australian.

Mr Belo accused the Government of covering up corruption by muzzling the country's media.

Mr Salatian has claimed his life was threatened by Pualaka Petroleum executives after he expressed concerns about the contract and demanded the company first settle a $US51,500 ($76,000) debt to Sunshine.

Fretilin opposition MP Jose Teixeira rejected Ms Lobato's claims of innocence and repeated his party's demand for the Government to sack the minister.

Your Excellency the President of the Republic,
Your Excellency, Madame Governor-General,
Your Excellency the President of the National parliament,
Excellencies, Distinguished Guests.

As the Parliamentary leader of Timor-Leste's historic party that gave birth to our national liberation struggle, the party that bore the brunt of our 24-year long struggle for independence, my colleagues and I join other members of this parliament in welcoming you on your first visit to Timor-Leste. We hope and pray and urge of you that it will not be your last visit to our country. You will always be welcome.

Madam Governor-General, we are especially honoured that a person, and dare I say it, a woman of your distinction, Australia's first woman Governor General has honoured us with your visit. Your Excellency has a long and distinguished career in the defense of social, civil and political rights as a lawyer and advocate in Australian public life.

You have a history as a defender and promoter of women's rights. You have become a role model for this generation of young women in your country to seize the day. You have been a strong defender and advocate of the rights of indigenous Australians, the first Australians and reconciliation between white and black Australia. You have defended advocated for the rights of those citizens in your country who are physically challenged to equal treatment in their society.

There is not sufficient time for me to give justice by detailing your Excellency's distinguished career as a jurist or in regard to your public service prior to being appointed Governor General. But your role as the Director, Human Rights and Equal Opportunity Commission, Queensland, between 1987-1988 and the Federal Sex Discrimination Commissioner, Human Rights and Equal Opportunity Commission, between 1988-1993 is noteworthy to us.

This is noteworthy because the struggle for human rights was at the centre of our peoples' struggle for self-determination. Your Excellency presided over the development of the human rights equal opportunity commission into a strong and effective institution for the defense of social, civil and political rights in Australia. We know of your service with dedication and distinction that set a standard for many Commissioners to follow.

As I welcome your Excellency to our parliament, our people's sovereign house that is constitutionally entrusted with the responsibility of promoting and defending those same rights you defended in your long and distinguished career, I urge you as the constitutional head of state of a country with whom Timor-Leste has had a long and close bond of friendship to continue to serve the promotion and the defense of all the social, civil and political rights that the United Nations' Universal Charter of Human Rights seeks to guarantee for both our peoples.

Only last week, we all celebrated International Human Rights Day.
That day was a commemoration of a dream of the founders of the United Nations that one day, more than it is today, human rights will be absolutely respected throughout our whole global community. This is a dream your Excellency also shares given your service to the cause.

If you will permit me to say so Your Excellency, people such as yourself, still have work ahead of you to promote and defend the aspirations of people such as ours in emerging democracies to live under the rule of law and in a society that respects our universal human rights.

The promotion and defense of human rights should know no territorial boundaries, no frontiers, no borders. We are united in human fraternity on this issue. It will be by all nations respecting the universal human rights of theirs and other nations' citizens that peace and understanding can foster in our world.

We urge you as a long time defender of these rights to continue to play that role within the bounds of your responsibility as a head of state not just for Australia, not just for the Asia Pacific but the global human village, in so doing promoting greater peace and understanding between nations and people.

Once again, welcome to our Country and our parliament.

Causas da violência de 2006 estão por resolver, diz enviado de Direitos Humanos

Díli, 15 Dez (Lusa) - As causas da violência de 2006 em Timor-Leste estão por resolver, afirmou à Agência Lusa em Díli um enviado-especial das Nações Unidas no final de uma visita ao país.

“As causas da violência de 2006 não tiveram atenção suficiente”, afirmou Walter Kälin, representante-especial do secretário-geral da ONU para os Direitos Humanos dos Deslocados Internos.

Walter Kälin realizou uma visita de seis dias a Timor-Leste, durante a qual visitou vários campos de deslocados fora de Díli e manteve encontros com as autoridades timorenses.

Walter Kälin elogiou o sucesso do regresso de deslocados e o encerramento de mais de metade dos campos nos últimos meses mas sublinhou que ainda é cedo para afirmar se esse regresso é consistente e de longo-prazo.

“Muitos dos deslocados (que visitei) disseram que apenas se sentem seguros porque há uma esquadra de polícia nas proximidades e aqueles sem um posto de polícia indicaram este ponto no topo das suas prioridades”, explicou o enviado do secretário-geral da ONU.

“Se estes regressos são apoiados de forma a serem sustentáveis e se haverá soluções para aqueles que não podem regressar às comunidades, serão indicadores importantes sobre se Timor-Leste será capaz de quebrar finalmente o ciclo de violência e deslocação de populações que marcaram a sua história desde 1975”, referiu Walter Kälin.

O enviado-especial do secretário-geral defendeu também que “tem que se enfrentar a impunidade pelos crimes cometidos em 2006”, durante a crise política e militar que causou mais de 30 mortos e deixou mais de cem mil deslocados, sobretudo na capital.

“A impunidade é um assunto abrangente neste país e não apenas em relação a 2006. Há pessoas a mais acima da lei em Timor-Leste”, referiu Walter Kälin à Lusa.

O enviado da ONU constatou também na sua visita que “questões de terra e propriedade por resolver podem ser um novo motivo para violência e deslocação de populações”.

Sobre a estratégia do Governo para os deslocados, Walter Kälin nota que “de certa forma combina duas fases que são distintas noutros países: o apoio à recuperação, de diversas formas incluindo géneros ou dinheiro, e a compensação por danos sofridos”.

“A vantagem desta estratégia é que a reconstrução das casas devia acontecer rapidamente. Ao mesmo tempo,porém, vejo o problema de esta abordagem não cobrir a assistência aos mais vulneráveis, como as mulheres com muitos filhos e sem casa”, notou Walter Kälin.

Comparando com situações noutros países, Walter Kälin referiu que os deslocados da crise de 2006 ficaram sobretudo na capital, em áreas de fácil acesso da assistência e sem problemas de segurança graves como em países onde os deslocados ficam em áreas remotas sujeitos a ataque.

Outra diferença sublinhada por Walter Kälin foi a forma como os deslocados timorenses conseguiram organizar-se e fazer-se ouvir, “para o que contribuiu o facto de serem na maioria apoiantes de um partido, embora haja sempre uma dimensão política nestas situações”.
