U.S District Court clears Timor Sea Designated Authority of Claims brought by Oceanic Exploration


The Timor Sea Designated Authority (TSDA) is delighted to announce that all claims filed against the TSDA by Oceanic Exploration have been dismissed.

Among the claims raised by Oceanic Exploration on June 2004, were allegations that the TSDA award of Production Sharing Contracts to ConocoPhillips and its joint venture partners was invalid due to bribery, coercion or fraud. Such allegations were vigorously denied by the TSDA.

On 21 September 2006, the TSDA received a Court Order from the United States District Court for the District Court of Columbia dismissing claims made by Oceanic Exploration and its subsidiary PetroTimor against the TSDA.

Judge Emmet G. Sullivan in his decision wrote:
“This Court is precluded from instructing the governments of both East Timor and Australia that they should disrupt a decade of economic investment and development in their own valuable natural resources, and instead afford companies, like plaintiffs Oceanic, an opportunity to compete or bid for concession rights. Accordingly, the act of state doctrine bars this Court from adjudicating any of the plaintiffs’ claims against the TSDA.”

“I am extremely pleased with the outcome. The Governments of Timor-Leste and Australia ratified the Timor Sea Treaty which gave rise to the Production Sharing Contracts awarded to the ConocoPhillips consortium. It was not, as Oceanic Exploration allege, the bribery of a foreign government office and the TSDA in order to obtain a commercial contract”, said Niny Borges, the Acting Executive Director of the TSDA.

A Autoridade Designada do Mar de Timor (TSDA) tem o prazer de anunciar que todas as queixas apresentadas contra a TSDA pela Oceanic Exploration foram rejeitadas.

Entre as queixas levantadas pela Oceanic Exploration em Junho 2004, estiveram alegações de que a adjudicaçãp pela TSDA à ConocoPhillips e seus parceiros de Contractos de Partilha de Produção eram inválidos por causa de subornos, coerção ou fraude. Tais alegações foram vigorosamente refutadas pela TSDA.

Em 21 de Setembro de 2006, a TSDA recebeu uma Nota do Tribunal do Tribunal Distrital dos USA para o Tribunal do Distrito de Columbia rejeitando as queixas feitas pela Oceanic Exploration e pela sua subsidiária PetroTimor contra a TSDA.

Escreveu o Juíz Emmet G. Sullivan na sua decisão:
“Este Tribunal está impedido de dar ordens aos governos de ambos os países Timor-Leste e Austrália que deverão interromper uma década de desenvolvimento e investimento económico nos seus próprios recursos naturais valiosos, e em vez disso dá a companhias, como a Oceanic, uma oportunidade para competir ou para concorrer a direitos de concessões. Consequentemente, a lei da doutrina estatal impede este Tribunal de aceitar qualquer das queixas dos queixosos contra a TSDA.”

“Estou extremamente satisfeito com o resultado. Os Governos de Timor-Leste e da Austrália ratificaram o Tratado do Mar de Timor que possibilitou os Contractos de Partilha de Produção entregues ao consórcio da ConocoPhillips. Isso não foi, como a Oceanic Exploration alega, um suborno a um gabinete de governo estrangeiro ou à TSDA de modo a obter um contracto comercial”, disse Niny Borges, o Director Executivo em Exercício da TSDA.

Well Well- a US Court clears the Alkatiri government of corruption in respect of this matter.

Its funny how the real story is now being painted. Lets see:

1. Railos' allegations remain just that.

2. The vote by show of hands was declared to be in accordance with the Law on Political Parties.

3. The corruption claims made by Oceanic Exploration against Alkatiri have proven false.

Viva Fretilin, Alkatiri and Timor Leste.

This 10:19:28 AM anonymous is either braindead or manipulative.

Mari could never have been cleared by the court from any wrongdoing because he was never a plaintiff. GET IT?? The acussation was lodged by OCEANIC EXPLORATION against PHILLIPS PETROLEUM with evidence that included alledged bribes accepted by Mari Alkatiri.

Sesondly the court did not CLEAR ANYONE. It did not even say that Phillips Petroleum did not do anything wrong. It merely DISMISSED the complaint because it states that "Accordingly, the act of state doctrine bars this Court from adjudicating any of the plaintiffs’ claims against the TSDA.”"
So again the court basically stated that it could not hear the complaint lodged by Oceanic Exploration and make a judgement on it.

Get your facts right and either smarten uo or stop throwing sand into people's eyes.
