The following is a translation from the<BR/>original published in the Portuguese press[1]:<BR/><BR/>Your Excellency<BR/>Prime Minister<BR/>Dr Mari Alkatiri<BR/><BR/>Re: Attached copy of Four Corners documentary<BR/><BR/>There having been transmitted on the ABC Four Corners program last<BR/>night at 7:30 pm and, allegations of the same tenor having been<BR/>transmitted also on the RTTL[2] , at 7:00 pm, as well as, in recent<BR/>days, by various national and international communications media,<BR/>grave accusations of your involvement in the distribution of weapons<BR/>to civilians, I am sending you the video for your consideration.<BR/><BR/>Having seen the Four Corners program, which shocked me immensely, all<BR/>that I can now do is to give you the opportunity to decide: either you<BR/>resign or, having consulted the Council of State, I will dismiss you,<BR/>because you have ceased to merit my confidence as President of the<BR/>Republic.<BR/><BR/>I await your letter of reply by 5 pm today, 20 June 2006.<BR/><BR/><BR/>Yours sincerely,<BR/><BR/><BR/><BR/>Palácio das Cinzas, 20 June 2006.<BR/>President of the Republic<BR/>Kay Rala Xanana Gusmão<BR/><BR/>The Constitution of the Democratic Republic of East Timor sets out the<BR/>respective roles of the President and the Prime Minister in quite<BR/>clear terms.<BR/><BR/>The President is elected by direct universal suffrage using the<BR/>European system of run-off elections if no candidate receives an<BR/>absolute majority (art 76, Constitution).<BR/><BR/>The Prime Minister is selected by the party or coalition having a<BR/>majority in Parliament and is then appointed by the President (art<BR/>106.1 Constitution).<BR/><BR/>Article 112 of the Constitution, dealing with the dismissal of the<BR/>government, states as follows:<BR/><BR/>1. The government is dismissed in the following circumstances:<BR/><BR/> a) A new legislative term begins;<BR/> b) The acceptance by the President of the Republic of the<BR/>resignation of the Prime Minister;<BR/> c) The death or permanent physical incapacitation of the Prime Minister;<BR/> d) The government's program is rejected for the second consecutive time;<BR/> e) A vote of confidence is not passed;<BR/> f) A vote of censure is passed by an absolute majority of the<BR/>Deputies in full exercise of their functions;<BR/><BR/> 2. The President of the Republic shall only dismiss the<BR/>Prime Minister in accordance with the cases provided for in the<BR/>previous item and when it is deemed necessary to ensure the regular<BR/>functioning of the democratic institutions, after consultation with<BR/>the Council of State. [3]<BR/><BR/>The immediately obvious interpretation of the words following the<BR/>conjunction "and" in the second paragraph is that each of the six<BR/>grounds for dismissal is qualified by a formal requirement of apparent<BR/>necessity. A different result would obtain if the word "and" were<BR/>replaced by "or". In that case, there would be a 7th distinct ground<BR/>of dismissal, effectively a wide-ranging discretion vested in the<BR/>President to dismiss the government whenever he/she thought the normal<BR/>functioning of democracy required it, subject to his/her hearing the<BR/>views of the Council of State.<BR/><BR/>Only by a very stretched and, it is submitted, unsustainable view<BR/>could it be said that the 7th ground is available without changing the<BR/>actual text.<BR/><BR/>The President's threat to dismiss the Prime Minister, however, appears<BR/>to rely on the "7th ground" interpretation, hence the reference to<BR/>consultation with the Council of State. Even if that interpretation<BR/>were correct, however, it would have to be said that the blunt terms<BR/>of the President's language seem to leave no real role for the Council<BR/>of State. A Constitutional imperative that the President consult with<BR/>the Council should imply that he should at least have an open mind<BR/>before hearing what the Council has to say.<BR/><BR/>In short, the President's threat to dismiss the Prime Minister was<BR/>undoubtedly unconstitutional.<BR/><BR/>The rapid succession of events in the days following the delivery of<BR/>the letter suggest that Gusmão's advisers may have confirmed the<BR/>unconstitutionality of the threat. Certainly, Alkatiri's failure to<BR/>resign by the deadline resulted not in a purported dismissal by the<BR/>President but instead led to the President's ultimatum in a public<BR/>statement on 22 June that, if the Prime Minister did not resign by the<BR/>next day, then he would do so.<BR/><BR/>In the same statement, Gusmão referred to the Congress of the Fretilin<BR/>party which had taken place in May, during which Alkatiri was<BR/>re-elected Secretary-General by a "show of hands" vote of over 97%.<BR/>The President described this as unlawful, pointing out that Article<BR/>18(c) of the Political Parties Law requires all office-bearers to be<BR/>elected by direct and secret ballot.<BR/><BR/>This time the President appears to have been on firmer ground, but<BR/>what did it mean for the status of the Prime Minister? There is no<BR/>reason to suppose that the requirements of 18(c) apply to the majority<BR/>party's selection of the Prime Minister under Article 106 of the<BR/>Constitution, and in any event the Political Parties Law only came<BR/>into effect in 2004, by which time Alkatiri had been in the job for<BR/>over two years. But would it be relevant to the unfolding crisis?<BR/><BR/>The President's new threat to himself resign if Alkatiri did not was a<BR/>bold gamble. Again the Constitution seemed to work against his<BR/>intentions, since it contemplated in Article 82.1 that on his<BR/>resignation the post of President of the Republic would be filled<BR/>automatically by the Speaker of the Parliament, in the person of<BR/>Francisco Guterres "Lu-Olo", a staunch supporter of Alkatiri within<BR/>Fretilin. Moreover, following his resignation Gusmão would be<BR/>prevented from standing at the next Presidential elections or indeed<BR/>at any such election in the following five years (art 81.3).<BR/><BR/>The response of the Prime Minister has been to rely on the right of<BR/>the majority party to nominate the person who fills his position, and<BR/>therefore to refuse to resign until Fretilin's Political Committee<BR/>authorises him to do so. But what then of the Political Parties Law?<BR/>If the party elections in May were unlawful, who now has the<BR/>legitimacy to decide the Prime Minister's fate within the party?<BR/><BR/>As this article is concluded the battle lines in Dili remain drawn up,<BR/>without (metaphorically or, thankfully, literally) any shots being<BR/>fired. It is obvious that the final results will not be written up by<BR/>jurists, except to the extent that the "doctine of effectiveness" will<BR/>ultimate prevail and a new volume of the law of East Timor will have<BR/>to be opened.
